AGREEMENT ESTABLISHING AN ALLIANCE
BETWEEN
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION
U.S. DEPARTMENT OF LABOR
BIRMINGHAM AND MOBILE, ALABAMA AREA OFFICES
AND
ALABAMA TRUCKING ASSOCIATION
WORKERS COMPENSATION FUND

The Occupational Safety and Health Administration (OSHA) and the Alabama Trucking Association Workers Compensation Fund (ATAWCF) recognize the value of establishing a collaborative relationship to foster safer and more healthful American workplaces. OSHA and the ATAWCF hereby form an Alliance to provide ATAWCF members and others with information, guidance, and access to training resources that will help them protect employees' health and safety, particularly in reducing and preventing exposure to hazards on the highway, at pick-up and delivery points, at maintenance shops, and administrative business locations, to include traffic accidents, road rage, musculoskeletal stressors, struck-by incidents, chemical exposures, electrical shocks and burns, welding hazards, moving parts of machinery, slips, trips, falls, and general safety and health issues through hazard recognition training and development of safety and health programs. In developing this Alliance, OSHA and the ATAWCF recognize that OSHA's State Plan and Consultation Project partners are an integral part of the OSHA national effort.

OSHA and the ATAWCF will work together to achieve the following training and education goals:

  • Work with OSHA to provide expertise to develop training and education programs for employers in the trucking industry regarding safety and health hazards, and to provide expertise in communicating such information to ATAWCF employees and association members.
     
  • Deliver or arrange for the delivery of courses, i.e., effective safety and health programs (management commitment and employee involvement, worksite analysis, hazard control and elimination, training), incident investigation, fall protection, hazard recognition, and trend analysis.
     
  • Work with OSHA to provide expertise to develop workplace safety and health curricula on worksite hazards encountered on the highway, at delivery and pick-up sites, and at fixed member locations to include traffic accidents, road rage, musculoskeletal stressors, struck-by incidents, chemical exposures, electrical shocks and burns, welding hazards, moving parts of machinery, slips, trips, falls, and general safety and health issues.

OSHA and the ATAWCF will work together to achieve the following outreach and communication goals:

  • Work with OSHA to provide expertise in developing information on the recognition and prevention of workplace hazards, and to provide expertise in developing ways of communicating such information (e.g. print and electronic media, electronic assistance tools and OSHA's and the ATAWCF web sites) to employers and employees in the industry.
     
  • Speak, exhibit, or appear at OSHA's or ATAWCF conferences, local meetings or other safety events.
     
  • Share information among OSHA personnel and industry safety and health professionals regarding the ATAWCF best practices or effective approaches and publicize results through outreach by the ATAWCF and through OSHA or ATAWCF developed materials, training programs, workshops, seminars, and lectures.
     
  • Encourage Trucking Association Workers Compensation Fund Members and their worksites to build relationships with OSHA's Regional and Area offices to address health and safety issues, including the development of safety and health programs necessary to prevent injuries and illnesses.

OSHA and the ATAWCF will work together to achieve the following goals related to promoting the national dialogue on workplace safety and health:

  • Convene or participate in forums, round table discussions or stakeholder meetings on safety and health issues to help forge innovative solutions in the workplace to develop formal safety and health procedures to control hazards in the workplace.

OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as training and education, outreach and communication and promoting a national dialogue on workplace safety and health. These Alliances have proven to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing any of that party's products or services; nor does the Agency enter into an Alliance with the purpose of promoting a particular party's products or services.

An implementation team made up of representatives of both organizations will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance.

This agreement will remain in effect for two years. Either signatory may terminate it for any reason at any time provided they give 30 days written notice. This agreement may be modified at any time with the concurrence of both signatories.

FLORIDA GULF COAST CHAPTER

The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) Tampa Area Office and the Associated Builders and Contractors, Inc., Florida Gulf Coast Chapter (ABC, Florida Gulf Coast Chapter) continue to recognize the value of maintaining a collaborative relationship to foster safer and more healthful American workplaces. To that end, OSHA and the ABC, Florida Gulf Coast Chapter hereby renew the Alliance signed June 12, 2008, and renewed February 25, 2011, April 9, 2013 and April 12, 2016, with a continued emphasis on reducing and preventing exposure to falls, trenching and excavation, scaffold, confined space, struck-by, chemical and electrical hazards, as well as other prevalent safety and health hazards in the construction industry. Specifically, OSHA and the ABC, Florida Gulf Coast are committed to providing the ABC, Florida Gulf Coast members and others with information, guidance, and access to training resources that will help them protect the health and safety of workers and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act). Through the Alliance, the organizations will continue to place emphasis on effectively communicating these issues to hard-to-reach groups, such as non-English speaking and youth workers.

This agreement provides a framework and objectives for the Alliance's activities. Alliance participants also agree to meet the requirements for program participation laid out in the "Fundamental Requirements for OSHA Alliance Program Participants" and the "Guidelines for OSHA's Alliance Program Participants: Alliance Products and Other Alliance Projects."

Through the Alliance, the organizations will use injury, illness, and hazard exposure data, when appropriate, to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. In renewing this Alliance, OSHA and the ABC, Florida Gulf Coast Chapter recognize that OSHA's State Plan and On-Site Consultation Project partners are an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be shared with these partners for the advancement of common goals.

Raising Awareness: Outreach and Communication

The Participants intend to work together to achieve the following objectives:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and OSHA's and the ABC, Florida Gulf Coast Chapter Web sites) to employers and workers in the industry.
  • To speak, exhibit, or appear at OSHA's or ABC, Florida Gulf Coast Chapter's conferences, local meetings, or other ABC, Florida Gulf Coast Chapter's events.
  • To convene or participate in forums, roundtable discussions, or stakeholder meetings on prevalent hazards in the construction industry to help forge innovative solutions in the workplace or to provide input on safety and health issues.

Training and Education

The Participants intend to work together to achieve the following objectives:

  • To develop effective training and education programs for construction workers regarding fall protection, trenching and excavation, electrical safety, scaffold safety, confined space safety, steel erection, struck-by hazards and health issues, such as silica and hexavalent chromium, and to communicate such information to constituent employers and workers, including hard-to-reach groups (non-English speaking and youth workers).
  • To deliver or arrange for the delivery of the aforementioned courses.

OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA's initiatives, outreach, communication, training and education. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that party's products or services.

An implementation team made up of representatives of each organization will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least two times per year to track and share information on activities and results in achieving the goals of the Alliance. OSHA team members will include representatives of the Tampa Area Office and any other appropriate offices. OSHA will encourage State Plan States' and OSHA On-site Consultation Projects' participation on the team.

This agreement will remain in effect for two-years. Either signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the written concurrence of both signatories.

Events

  • The development of training and education programs for employees focusing on safety and health issues related to the electrical utility industry is one of the goals of this agreement. Course topics included grounding, OSHA 10-hour training course, supervisory training, OSHA Power Transmission and Distribution Standard and others. However, these tables only reflect the personnel trained by SELCAT.

  • In 2007, the Alliance document was posted on NECA’s Website, to promote the cooperative agreement (www.slccneca.org). The Chapter Website also offers to the employees and member companies an opportunity to communicate “near misses” with other participants.
  • In 2007, a system was developed and implemented which enabled participating employers and workers to best practices
  • Developed and disseminated the Safety Alliance Update Quarterly Newsletter and Brochure to reach over 2,000 employees and companies. To date two newsletters have been issued to the target group for July 2007 and December 2007.

Promoting the National Dialogue on Workplace Safety and Health
Events

  • In January 2007, Les Grove, Area Director, OSHA Region IV, Tampa, Florida, Area Office, and Steve Gaines participated in a panel discussion, gave presentations on the Alliance and answered participants' questions at the Outside Apprenticeship Conference in Orlando, Florida. Approximately 200 employers and employees attended this meeting.
  • In August 9-11, 2007, Bill Grimes, OSHA Region IV, Assistant Regional Administrator, Cooperative and State Programs, Atlanta, Georgia, and Steve Gaines gave a presentation on the OSHA and IBEW Alliance and the OSHA Strategic Partnership with the electrical industry at the Fifth District IBEW meeting in New Orleans, Louisiana. Approximately 170 Union Official and representative attended this meeting.

The Alliance participants will ensure that experienced workers, as well as, inexperienced workers, including, but not limited to apprentices lineman will receive training.

    Alliance Overview:

    The Occupational Safety and Health Administration (OSHA) Area Office in Raleigh, North Carolina (Raleigh Area Office), the Department of the Navy – Fleet Readiness Center East (FRCE), the International Association of Machinist and Aerospace Workers (IAMAW), the American Federation of Government Employees (AFGE), and the National Association of Aeronautical Examiners (NAAE) unions formed an Alliance to provide union members and others with information, guidance, and access to training resources that will help them protect the health and safety of workers, particularly by reducing and preventing exposure to prevalent aircraft maintenance hazards and heat illnesses, as well as hazards unique to the Navy aircraft maintenance environment.

    Implementation Team Members:

    The implementation team consists of representatives from the Raleigh OSHA Area Office and the Department of the Navy – Fleet Readiness Center East (FRCE).

    The group conducted Alliance implementation team meetings, in person, by telephone, and through e-mail correspondence on the following dates: December 4, 2013; February 25, 2014 and August 1, 2014.

    Events

    • On April 22, 2014, management and union representatives from the FRCE attended the North Carolina (NC) - Federal Safety& Health Council (FFSHC) meeting and training session in Raleigh, NC. During this event the following safety and health topics were addressed: powered industrial truck; fall protection; and heat illness prevention. A wide range of OSHA outreach material was also distributed during this event.
    • On June 2, 2014, representatives from the OSHA Raleigh Area Office attended the NC – FFSHC meeting and training session hosted by the FRCE.  During this event training was during directly in support of OSHA’s National Fall Prevention Safety Stand-down, as well as OSHA’s Heat Illness Prevention Campaign.  OSHA outreach material supporting both campaigns was distributed during this event.
    • On October 20, 2014, management and union representatives from the FRCE attended the NC-FFSHC meeting and training session in Raleigh, NC. During this event the following safety and health topics were addressed: a recent fatal at another military installation, the ongoing Ebola epidemic, post-traumatic stress disorder (PTSD), OSHA’s revised recordkeeping reporting procedures and other issues.  A wide range of OSHA outreach material was also distributed during this event.
    • On December 1, 2014, the Alliance group participated in the FRCE Safety and Health Council’s close-out meeting.   During this event the following safety and health topics were addressed: safety culture, the injury and illness rates for the installation, as well as incident trends (which were sorted by type and location).

    • The Alliance group will evaluate the Vortex Cooling Vest in preventing heat-related illnesses and shared the results.

THE ASSOCIATED BUILDERS AND CONTRACTORS, INC.,
FLORIDA GULF COAST CHAPTER

The Occupational Safety and Health Administration (OSHA) and the Associated Builders and Contractors, Inc., Florida Gulf Coast Chapter recognizes the value of establishing a collaborative relationship to foster safer and more healthful American workplaces. OSHA and ABC's Florida Gulf Coast Chapter hereby form an Alliance to provide ABC's Florida Gulf Coast Chapter members and others with information, guidance, and access to training resources that will help them protect employees' health and safety, particularly in reducing and preventing exposure to falls, trenching and excavation, scaffold, confined space, struck-by, chemical and electrical hazards, as well as other prevalent safety and health hazards in the construction industry. Emphasis will also be placed on effectively communicating these issues to hard-to-reach groups, such as non-English speaking and youth workers. In developing this Alliance, OSHA and ABC's Florida Gulf Coast Chapter recognize that OSHA's State Plan and the Onsite Consultation project partners are an integral part of the OSHA national effort.

OSHA and ABC's Florida Gulf Coast Chapter will work together to achieve the following training and education goals:

  • Work with OSHA to provide expertise to develop training and education programs for employers in the construction industry regarding fall protection, trenching and excavation, electrical safety, scaffold safety, confined space safety, steel erection, struck-by hazards and health issues, such as silica and hexavalent chromium, and to provide expertise in communicating such information to employers and employees in the industry.
     
  • Work with OSHA to develop training and education programs addressing the aforementioned topics in Spanish and for youth workers through the chapter's apprentice program.
     
  • ABC's Florida Gulf Coast Chapter will deliver or arrange for the delivery of the above courses.

OSHA and ABC's Florida Gulf Coast Chapter will work together to achieve the following outreach and communication goals:

  • Work with OSHA to provide expertise in develop information on the recognition and prevention of workplace hazards, and to provide expertise in developing ways of disseminating such information (e.g. print and electronic media, electronic assistance tools and OSHA's and the ABC's Florida Gulf Coast Chapter Web sites) to employers and employees in the industry.

  • Encourage other ABC, Florida Gulf Coast Chapter members to build relationships with OSHA's Regional and Area Offices to address health and safety issues. ABC's Florida Gulf Coast Chapter members will also be encouraged to register to receive the OSHA Region IV newsletter.

OSHA and the ABC's Florida Gulf Coast Chapter will work together to achieve the following goals related to promoting the national dialogue on workplace safety and health:

  • Raise others' awareness of and demonstrate their own commitment to workplace safety and health whenever ABC's Florida Gulf Coast Chapter leaders address groups.
     
  • Convene or participate in forums, round table discussions, or stakeholder meetings on safety issues to help forge innovative solutions in the workplace or to provide input on safety and health issues.

OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as training and education, outreach and communication and promoting a national dialogue on workplace safety and health. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing any of that party's products or services; nor does the Agency enter into an Alliance with the purpose of promoting a particular party's products or services.

An implementation team made up of representatives of both organizations will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least three times a year to track and share information on activities and results in achieving the goals of the Alliance.

This agreement will remain in effect for two years from the date of signing. Either signatory may terminate the agreement for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the concurrence of both signatories.
