AGREEMENT RENEWING AN ALLIANCE
BETWEEN
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION

THE ASSOCIATED BUILDERS AND CONTRACTORS, INC.,
FLORIDA GULF COAST CHAPTER

The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) Tampa Area Office and the Associated Builders and Contractors, Inc., Florida Gulf Coast Chapter (ABC, Florida Gulf Coast Chapter) continue to recognize the value of maintaining a collaborative relationship to foster safer and more healthful American workplaces.  To that end, OSHA and the ABC, Florida Gulf Coast Chapter hereby renew the Alliance signed June 12, 2008, with a continued emphasis on reducing and preventing exposure to falls, trenching and excavation, scaffold, confined space, struck-by, chemical and electrical hazards, as well as other prevalent safety and health hazards in the construction industry.  Specifically, OSHA and the ABC, Florida Gulf Coast are committed to providing the ABC, Florida Gulf Coast members and others with information, guidance, and access to training resources that will help them protect the health and safety of workers and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).  Through the Alliance, the organizations will continue to place emphasis on effectively communicating these issues to hard-to-reach groups, such as non-English speaking and youth workers.    In renewing this Alliance, OSHA and the ABC, Florida Gulf Coast Chapter recognize that OSHA's State Plan and On-site Consultation Project partners are an integral part of the OSHA national effort.

Raising Awareness of OSHA's Rulemaking and Enforcement Initiatives

The Participants intend to work together to achieve the following goal related to raising awareness of OSHA's rulemaking and enforcement initiatives:

  • To convene or participate in forums, roundtable discussions, or stakeholder meetings on prevalent hazards in the construction industry to help forge innovative solutions in the workplace or to provide input on safety and health issues.

Training and Education

The Participants intend to work together to achieve the following training and education goals:

  • To develop effective training and education programs for construction workers regarding fall protection, trenching and excavation, electrical safety, scaffold safety, confined space safety, steel erection, struck-by hazards and health issues, such as silica and hexavalent chromium, and to communicate such information to constituent employers and workers, including hard-to-reach groups (non-English speaking and youth workers).
  • To deliver or arrange for the delivery of the aforementioned courses.

Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication goals:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and OSHA's and the ABC, Florida Gulf Coast Chapter Web sites) to employers and workers in the industry.
  • To speak, exhibit, or appear at OSHA's or ABC, Florida Gulf Coast Chapter's conferences, local meetings, or other ABC, Florida Gulf Coast Chapter's events.

OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA's rulemaking and enforcement initiatives, training and education, and outreach and communication.  These Alliances have proved to be valuable tools for both OSHA and its Alliance participants.  By entering into an Alliance with a party, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that party's products or services.

An implementation team made up of representatives of each organization will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants.  In addition, they will meet at least three times per year to track and shareinformation on activities and results in achieving the goals of the Alliance.  OSHA team members will include representatives of the Tampa Area Office and any other appropriate offices.  OSHA will encourage State Plan States' and OSHA On-site Consultation Projects' participation on the team.

This agreement will remain in effect for two-years.  Either signatory may terminate it for any reason at any time, provided they give 30 days written notice.  This agreement may be modified at any time with the written concurrence of both signatories.

La Oficina Regional de Atlanta de la Administración de Seguridad y Salud Ocupacional (OSHA) del Departamento de Trabajo de los Estados Unidos de América y el Consulado General de Guatemala en Atlanta, en adelante denominados colectivamente “los Participantes”;

Reconociendo el compromiso conjunto de proteger el bienestar de los trabajadores guatemaltecos en los Estados Unidos reconocido en la Carta de Arreglo entre la Administración de Seguridad y Salud Ocupacional de los Estados Unidos de América y el Ministerio de Relaciones Exteriores de Guatemala, firmada en Washington, D.C., el 16 día de Junio, 2011; y

Reconociendo que el Programa de Alianza de OSHA prevé el establecimiento de relaciones de cooperación para fines tales como la capacitación y la educación, difusión y comunicación, y para promover un diálogo nacional sobre la seguridad y la salud en el trabajo;

Se proponen establecer una Alianza para lograr lo siguiente:

Objetivo General

Los Participantes tienen la intención de establecer una relación de colaboración para proveer a los nacionales guatemaltecos en Georgia, Norte Carolina, Tennessee, y Carolina del Sur información, orientación y acceso a recursos educativos y de capacitación con miras a promover los derechos de los trabajadores a la protección de su seguridad y salud ocupacionales, particularmente relacionados con la prevención de caídas, riesgos de amputación, riesgos asociados con zanja(s) y excavación(es), y riesgos eléctricos, y ayudarlos a comprender los derechos de los trabajadores y responsabilidades de los empleadores al amparo de la Ley de Seguridad y Salud Ocupacionales (OSH Act).

Capacitación y Educación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de capacitación y educación:

  • Dar discursos, realizar exposiciones o presentarse en las conferencias, reuniones locales u otros eventos de los Participantes.
  • Participar en las actividades y los eventos del “Consulado Móvil.”

Promoción de un Diálogo Nacional

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos relacionados con la promoción de un diálogo nacional sobre la seguridad y la salud en el lugar de trabajo:

  • Compartir información sobre las leyes y normas aplicables de los EE.UU., incluidas las relativas a los derechos de los trabajadores y las responsabilidades de los empleadores.

Un grupo de implementación, integrado por representantes de cada Participante, tiene la intención de reunirse para elaborar un plan de acción, determinar los procedimientos de trabajo y establecer las funciones y responsabilidades de los Participantes. Además, los Participantes tienen el propósito de reunirse por lo menos tres veces al año con fines de seguimiento e intercambio de información sobre las actividades y los resultados en torno al logro de los objetivos de la Alianza.

Nada de lo dispuesto en el presente Arreglo compromete a los Participantes a erogar recursos.

Este Arreglo puede iniciarse una vez firmado por los dos Participantes. El presente Arreglo tiene por objeto suspender dos (2) años después de la fecha de su firma. El Participante que tenga la intención de dar por terminado el presente Arreglo procurará notificar por escrito al respecto con treinta (30) días de antelación. El presente Arreglo podrá modificarse por escrito en cualquier momento mediante el consentimiento mutuo de los Participantes.

    Alliance Overview

    The Occupational Safety and Health Administration (OSHA) and the United Safety Council, Inc. (USC) agreed to establish an Alliance to reduce and prevent employee exposure to workplace hazards associated with disasters by developing and sharing information, guidance, and training resources on emergency preparedness and effective response.

    • During this period the USC conducted a total of fifty-nine classes addressing occupational safety and health issues cover by the Alliance, such as, workplace violence, emergency preparedness, CPR, first aid, AED and safety management systems.
       
    • The USC also facilitated nine OTI safety and health training courses, which were conducted by the University of South Florida.

    • On August 8, 2008, the University of Florida coordinated with the USC Alliance to host a “Worker Safety Training for Hurricane Preparation and Reconstruction” at the USC,
       
    • On August 26, 2008, a second University of Florida “Worker Safety Training for Hurricane Preparation and Reconstruction” was held at the USC.
       
    • On February 25, 2009, the USC held the first of a two part series on Workplace Violence. The presentation gave general information on what exactly is workplace violence and general prevention guidance. Participants were provided with the NIOSH DVD “Violence on the Job.”
       
    • March 20, 2009, the USC hosted a four hour training on “Mishap Prevention and Investigations.” The training covered tools and techniques used to perform a comprehensive accident investigation.
       
    • April 10, 2009, conducted the second part of the Workplace Violence two part series. Participants were provided with OSHA publication “Guidelines for Preventing Workplace Violence for Health Care and Social Service Workers”, NIOSH DVDs “Violence on the Job” and “Working with Stress” and sample prevention plans from various state OSHA programs.
       
    • The USC Alliance was promoted during several OSHA outreach presentations conducted throughout Central Florida. The Alliance also assisted in the distribution of safety & health outreach material such as the Region IV Photo and Struck-by CDs, Tool Box Reviews, MAD IV Roofing and Carpentry Toolbox Reviews and OSHA Quick Cards.

    • On June 10, 2008, the Alliance was promoted during a presentation to the Professional Association of Health Care Management in Springhill, FL.
       
    • On June 19-21, 2008, the Alliance and “Worker Safety Training for Hurricane Preparation and Reconstruction” program was promoted during the statewide Florida Roofing, Sheet Metal and Air Conditioning Conference.
       
    • July 31-August 2, 2008, the Alliance and “Worker Safety Training for Hurricane Preparation and Reconstruction” program was promoted during the regional Southeast Building Conference.
       
    • On January 16, 2009, the Alliance was promoted during the USC Safety Awards in Orlando, FL where representatives from national and international companies attended.
       
    • February 17-19, 2009, the Alliance was promoted during the national Common Ground Alliance Conference.

      The U.S. Department of Labor's (US DOL) Occupational Safety and Health Administration (OSHA), represented by the Atlanta Regional, Atlanta-East, Atlanta-West and Savannah, GA, Area Offices, the Georgia Tech Research Institute's Occupational Safety and Health Division (GTRI), Southeast Center for Young Worker Safety and Health, and The Concerned Beauty & Barber Professionals (The CBBP), and (hereafter all parties shall be referred to as The CBP Alliance) formed an Alliance to provide The CBBP members and others with information, guidance, and access to training resources that will help them protect the health and safety of workers, particularly by reducing and preventing exposure to products that contain hazardous chemicals. Emphasis will also be placed on effectively communicating these issues to hard-to-reach groups, such as youth and Vietnamese workers.

    Training and Education: The Participants intend to work together to achieve the following training and education goal:

    • To develop effective training and education programs for The CBBP members and others regarding reducing and preventing worker exposure to hazardous products. Emphasis will be placed on effectively communicating these issues to hard-to-reach groups, such as youth and Vietnamese workers.

AGREEMENT RENEWING AN ALLIANCE
BETWEEN
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION
U.S. DEPARTMENT OF LABOR

AND
THE UNITED SAFETY COUNCIL, INC.

The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) Tampa Area Office and the United Safety Council (USC) continue to recognize the value of maintaining a collaborative relationship to foster safer and more healthful American workplaces. To that end, OSHA and the USC hereby renew the Alliance signed May 6, 2008, with a continued emphasis on reducing and preventing exposure to the hazards associated with disasters and emergency preparedness. Specifically, both organizations are committed to providing the USC members and others with information, guidance, and access to training resources that will help them protect the health and safety of workers and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act). Through the Alliance, both organizations will continue to place additional emphasis on the development of effective safety and health tools (i.e., Safety and Health Management System, Emergency Preparedness Plan (for both natural and man-made disasters), Workplace Violence Awareness and Prevention Program, as well as First Aid, cardiopulmonary resuscitation (CPR) and automated external defibrillator (AED) Programs). Through the Alliance, the organizations will continue to place emphasis on effectively communicating these issues to hard-to-reach groups, such as non-English speaking and youth workers. In renewing this Alliance, OSHA and the USC recognize that OSHA’s State Plan and On-site Consultation Project partners are an integral part of the OSHA national effort.

Raising Awareness of OSHA’s Rulemaking and Enforcement Initiatives

The Participants intend to work together to achieve the following goal related to raising awareness of OSHA’s rulemaking and enforcement initiatives:

  • To Convene or participate in forums, round table discussions, or stakeholder meetings on workplace violence, emergency planning, and occupational safety and health programs to help forge innovative solutions in the workplace or to provide input on safety and health issues.

Training and Education

The Participants intend to work together to achieve the following training and education goals:

  • To develop effective training and education programs for employers and employees in general industry regarding a wide range of safety and health issues, such as safety and health management systems, emergency planning (including pandemic influenza), workplace violence, as well as first aid, cardiopulmonary resuscitation (CPR) and automated external defibrillator (AED) programs, and to communicate such information to constituent employers and workers.
  • To deliver or arrange for the delivery of certified training courses and other courses on the topics above.

Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication goals:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and OSHA’s and the USC’s Web sites) to employers and workers in the industry.
     
  • To speak, exhibit, or appear at OSHA’s or the USC’s educational awareness seminars, local meetings, or other events such as the annual USC Awards Meeting.

OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA's rulemaking and enforcement initiatives, training and education, and outreach and communication.  These Alliances have proved to be valuable tools for both OSHA and its Alliance participants.  By entering into an Alliance with a party, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that party's products or services.

An implementation team made up of representatives of each organization will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance. OSHA team members will include representatives of the Tampa Area Office and any other appropriate offices.

This agreement will remain in effect for two-years. Either signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the written concurrence of both signatories.

Overview

OSHA, Georgia Department of Transportation, Georgia Division of Federal Highway Administration, Georgia Highway Contractor’s Association, Georgia Utility Contractors Association, Association of County Commissioners of Georgia, Georgia Tech Research Institute, 3M Georgia Branch of the Associated General Contractors (AGC), Lamar Advertising and Georgia Power are committed to sharing their collective expertise to help foster a culture of injury and illness prevention while sharing best practices and technical knowledge, especially in the area of work zone safety and “Struck By” hazards.

II. Implementation Team and Contributors:

The implementation team members included representatives from OSHA, Georgia Department of Transportation, Georgia Division of Federal Highway Administration, Georgia Highway Contractor’s Association, Georgia Utility Contractors Association, Association of County Commissioners of Georgia, Georgia Tech Research Institute, 3M, Georgia Branch of the Associated General Contractors (AGC), Lamar Advertising and Georgia Power. Implementation team meetings were conducted as scheduled on 1/12/09, 2/18/09, 5/19/09, 6/10/09, 7/21/09, 9/9/09 and 11/10/09.

Savannah Area - Representatives from the ASSE, as well as OSHA’s Regional and Savannah Area Offices held a meeting on 9/12/05, 4/10/06, 5/08/06 and 7/10/06.

Training and Education

Events

  • On November 4, 2009, the Alliance group coordinated a state-wide “safety stand down.” During the “Safety Stand Down” construction sites across Georgia were encouraged to stop work and conduct an hour long work zone safety training presentation (focused on the prevention of struck by accidents). The group also developed an information flyer for the event and a toolbox talk (in both English and Spanish). The “Safety Stand Down” was supported by more than 90 construction firms, utility companies, schools, as well as state and local government agencies. The event impacted a total of 1,724 worksites, which covered a total of 16,194 employees.
  • The OSHA 10-hour training provided to Construction Career Technology students at DeKalb North – High School of Technology in January 26 – February 3, 2009, included mention of the Georgia Struck by Alliance and work zone safety.
  • The OSHA 10-hour training provided to Construction Career Technology students in Cass High School, February 11 and 12, 2009, included mention of the Georgia Struck by Alliance and work zone safety.
  • The OSHA 10-hour training was provided to Automotive Repair Career Technology students at Maxwell High School, March 9, 12 & 16, 2009, included mention of the Georgia Struck by Alliance and work zone safety.

Products

  • The group developed an informational flyer and a toolbox talk (in both English and Spanish) for the “Safety Stand Down.” The toolbox talk included a PowerPoint presentation which focused on worker safety and the prevention of work zones hazard.

Outreach and Communication

Events

  • On June 12, 2009, the Georgia Branch of the Associated General Contractors signed an addendum and joined the Alliance group.
  • On September 9, 2009, Lamar Advertising signed an addendum and joined the Alliance group
  • On November 10, 2009, Georgia Power signed an addendum and joined the Alliance group.

Products

  • An OSHA news release was issued regarding the “Safety Stand Down” on November 3, 2009.
  • An article about the “Safety Stand Down” appeared in the Atlanta Journal Constitution (AJC) newspaper prior to the event.
  • A story about the “Safety Stand Down” appeared on WALB-TV in Albany, Georgia.

Promoting the National Dialogue on Workplace Safety and Health

Events

  • Several members of the Alliance group participated in a ceremony and service in observance of the National Work Zone Safety Awareness Week. During the event the Commissioner, Georgia Department of Transportation, recognized the Georgia Struck by Alliance.

Products

  • The Alliance group supported the posted of two billboards by Lamar Advertising. The billboards urged vehicle operators to drive safety when enter the work zones. The billboards were posted in metro Atlanta and Augusta, Georgia

    The Occupational Safety and Health Administration (OSHA) and the Associated Builders and Contractors, Inc., Florida Gulf Coast Chapter (ABC Florida Gulf Coast Chapter) agreed to establish an Alliance to reduce and prevent employee exposure to health and safety hazards, such as, falls, trenching and excavation, scaffolds, confined space, struck-by, chemical and electrical hazards in construction by developing and sharing information, guidance, and training resources.

    • On October 17, 2011, the Alliance group conducted a presentation on how to "Take Your Safety Program from Good to Great." The training covered the elements of a Safety and Health Management System with examples delivered. The training was provided by an Alliance member and the Compliance Assistance Specialist (CAS) of the Tampa Area Office. Thirty-seven members and nonmembers attended the event.

    • On March 30, 2012, the Alliance group conducted a presentation on trenching and excavation. The OSHA CAS and an Alliance member conducted the presentation, which was attended by twenty-three members and nonmembers.

    • On July 25, 2012, the Alliance conducted a presentation on fall protection. The presentation covered methods for fall protection in various situations. The OSHA CAS and an Alliance member conducted the presentation, which was attended by thirty-seven members and nonmembers.

    • On November 2, 2012, the Alliance group conducted a presentation on scaffolding. The OSHA CAS and an Alliance member conducted the presentation, which was attended by thirty-five members and nonmembers.

Overview:

The Occupational Safety and Health Administration (OSHA), the Consul General of Mexico in Atlanta, and the Georgia Institute of Technology –Safety, Health, and Environmental Technology Division (Georgia Tech) OSHA formed an Alliance to provide Mexican workers throughout the southeast with information, guidance, and access to training resources that will help them protect employees’ health and safety and allow them to exercise their rights fully.

II. Implementation Team Membership and Contributors:

Representatives from OSHA, the Mexican Consulate and Georgia Tech conducted all required quarterly meeting on the following dates:

April 17, 2007 and April 27, 2007

  • Participated in the Latino Construction Worker Day event conducted in Duluth, GA, on April 15, 2007. The event was coordinated by a diverse group of organizations, including government agencies, academic institutions and companies. The primary organizer was El Constructor Latino magazine with cooperation from the Mexican Consulate in Atlanta, OSHA and the Georgia Institute of Technology. The fair included training on a wide range of safety and health topics (Scaffold, Excavation, Electrical and Fall Protection Safety, as well as Intro to OSHA).
     
  • On September 8, 2007, representatives from OSHA and the Mexican Consulate participated in the 2nd Annual Construction Safety Fair sponsored by the Hispanic Contractors Association of Georgia (HCAG) in Doraville, GA.
     
  • On October 15, 2007, the Atlanta-West CAS had a booth at the Mexican Consul Binational Health Week – Health Fair. The CAS addressed safety and health concerns and distributed outreach material. The event has been conducted by the Consul in Atlanta, GA, since 2003 and the week long fair serves approximately 4000 people.

  • The CAS in the Atlanta-West AO served on the planning committee of the Latino Construction Workers Day and developed an article about the event for the OSHA Region IV E-newsletter for the 2nd Quarter FY 2007.

      OSHA, Georgia Department of Transportation (GDOT), Georgia Federal Highway Administration (Georgia FHA), Georgia Highway Contractors Association (GHCA), Georgia Utility Contractors Association (GUCA), Association of County Commissioners of Georgia (ACCG), Georgia Tech Research Institute (Georgia Tech), 3M, Associated General Contractors of Georgia, Inc. (AGC Georgia), Lamar Outdoor Advertising, Georgia Power, Construction Education Foundation of Georgia (CEFGA), Pike Electric, National Safety Council (NSC) – Georgia Chapter, and Comcast formed an Alliance to share their collective expertise and to foster a culture of injury and illness prevention focused on the prevention of work zone and struck-by hazards.

    April 9 through 13, 2018, construction jobsites across Georgia were encouraged to cease work and participate in a Safety Stand-down led by the AGC Georgia. Struck-by Alliance members promoted this stand-down through a variety of venues, as well as the organization's contact list.

    The Struck-By Stand Down was a huge success with over 22,830 employees on 442 worksites from 21 companies participating. Jobsites were in the following locations: Alabama; Arizona; Arkansas; California; Colorado; Florida; Georgia; Illinois; Iowa; Kentucky; Louisiana; (Mexico City, Mexico); Michigan; Mississippi; Nevada; New York; North Carolina; Ohio; Pennsylvania; South Carolina; South Dakota; Tennessee; Texas; Utah; Virginia; Washington; West Virginia; Wisconsin; and Wyoming. Previous Struck-by Stand-down had the following results:

    • 2013 – 21 Companies, 104 Worksites and 1,435 Workers
    • 2014 – 25 Companies, 500 Worksites and 17,000 Workers
    • 2015 – 25 Companies, 400 Worksites and 15,000 Workers
    • 2016 - 16 Companies, 837 Worksites and 6,496 Workers
    • 2017 - 60 companies, 430 worksites and 25,400 employees

    • Speak, exhibit, or appear at Georgia Struck by Alliance member's conferences, local meetings, or other events.
    • To share information among OSHA personnel and industry safety and health professionals regarding Georgia Struck by Alliance member's good practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum) developed by the participants.

    On March 22 - 23, 2018, the Alliance group supported the CEFGA "World of Construction" at the Georgia International Convention Center (GICC), by working to provide a vehicle simulator for the event. The simulator was used to demonstrate the hazards of texting and driving to youth. The "World of Construction" was conducted in conjunction with the Georgia SkillsUSA competitions.

    The CEFGA "World of Construction" works to raise awareness regarding careers in construction, engineering, architecture, transportation, and energy, as well as educating students regarding workplace rights. The event represented a cooperative effort by private companies, trade associations, universities, and government agencies.

The AGC Georgia served a significant role in the success of this event by providing the registration platform for the event on its webpage.     • The Alliance group will support and participate in the 2019 World of Constructions/USA Skills Competition, with the goal of providing a vehicle simulator for the event to demonstrate the hazards of texting and driving to youth.
    • The Alliance group will continue to support the 2019 National Work Zone Awareness Week by conducting a safety stand-down event.
