AGREEMENT ESTABLISHING AN ALLIANCE BETWEEN
BOSTON AREA OFFICE SOUTH
PROVIDENCE AREA OFFICE
OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION
U.S DEPARTMENT OF LABOR
AND
CENTRO COMUNITARIO DE TRABAJADORES

The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) Boston Area South Area Office, Providence Area Office, and the Centro Comunitario de Trabajadores (CCT) recognize the value of establishing a collaborative relationship to foster safety and health practices and programs to improve American workplaces. To that end, OSHA and CCT hereby establish an Alliance with an emphasis on addressing workplace safety and health hazards faced by CCT’s constituency of immigrant and low-wage workers in southern New England, as well as understanding the rights of these workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

This agreement provides a framework and objectives for the Alliance's activities. Alliance participants also agree to meet the “Fundamental Requirements for OSHA Alliance Program Participants” and the “Guidelines for OSHA’s Alliance Program Participants: Alliance Products and Other Alliance Projects.”

Through the Alliance, the participants will use relevant injury, illness, and hazard exposure data, when appropriate, to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options to evaluate the effectiveness of the Alliance and measure the impact of its overall effort on improving workplace safety and health. In developing this Alliance, OSHA and CCT recognize that OSHA's State Plan and On-site Consultation Project partners are an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be shared with these partners for the advancement of common goals.

Raising Awareness: Outreach and Communication

The Participants intend to work together to achieve the following objectives related to raising awareness of OSHA's rulemaking and enforcement initiatives:

  • Share information on OSHA’s National/Regional/Local Initiatives (Emphasis Programs, Regulatory Agenda, Outreach), and opportunities to participate in initiatives and the rulemaking process.

  • Share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.

  • Share information regarding the rights as an employee under the whistleblower protection laws enforced by OSHA and the importance of filing complaints right away if someone believes they have been retaliated against for exercising those rights.

  • Speak, exhibit, or appear at OSHA and CCT’s conferences, local meetings, or other events.

  • Convene or participate in forums, roundtable discussions, or stakeholder meetings on low- wage and immigrant workers to help forge innovative solutions in the workplace or to provide input on safety and health issues.

  • Encourage worker participation in workplace safety and health regardless of immigration status and build relationships with OSHA’s Regional and Area Offices to address health and safety issues faced by low-wage and immigrant workers.

  • Share information among OSHA personnel and industry safety and health professionals regarding the Centro Comunitario de Trabajadores’ best practices or effective approaches through training programs, workshops, seminars, and lectures or other forums developed by the participants.

  • Collaborate with other Alliance participants on specific issues and projects on preventing workplace hazards for immigrant workers that are addressed and developed through the Alliance Program.

  • To develop and disseminate case studies on the specific difficulties and strategies found effective in preventing hazards faced by immigrants and publicize their results.

Training and Education

The Participants intend to work together to achieve the following training and education objectives:

  • Develop effective training and education programs regarding the workplace safety and health hazards experienced by CCT members and communicate such information to constituent employers and workers in a culturally and linguistically appropriate manner.

  • Develop effective training and education programs for CCT members which are culturally and linguistically appropriate to promote an understanding of workers' rights, including the use of the OSHA's complaint process, and the responsibilities of employers.

OSHA’s Alliances provide organizations an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA’s initiatives, outreach, communications, training, and education. These Alliances have proven to be valuable tools for both OSHA and Alliance participants. By entering into an Alliance with an organization, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that organization’s products or services.

An implementation team made up of representatives of each organization will meet one to two times per year to track and share information on activities and results in achieving the goals of the Alliance. OSHA team members will include representatives of the Boston Area South Area Office and Providence Area Office, along with any other appropriate offices. OSHA will encourage State Plan States' and OSHA On-site Consultation Projects' participation on the team.

This agreement will remain in effect for two years. Any signatory may terminate it for any reason at any time, provided the terminating signatory give 30 days’ written notice to the other. This agreement may be modified at any time with the written concurrence of all signatories

RECOGNIZING the joint commitment to protect workers’ rights for Mexican workers in the United States acknowledged in the Letter of Arrangement between the Occupational Safety and Health Administration of the Department of Labor of the United States of America and the Ministry of Foreign Affairs of the United Mexican States, concerning Workplace Safety and Health Protections Applicable to Mexican Workers in the United States, signed at Washington, D.C., on September 2, 2021; and

RECOGNIZING that OSHA’s Alliance Program provides for the establishment of cooperative relationships for purposes such as training and education, outreach and communication, and promoting a national dialogue on workplace safety and health;

Intend to form an Alliance to achieve the following:

Overall Objective

The Participants intend to establish a collaborative relationship to provide Mexican Nationals in Houston, Texas and others information, guidance, and access to education and training resources to promote workers’ rights in protecting their occupational safety and health, and to help them understand U.S. domestic law on the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

Training and Education

The Participants intend to work together to achieve the following training and education goals:

  • To develop training and education programs for Mexican workers and Mexican employers in Houston, Texas regarding workplace safety and health.

  • To develop training and education programs for Mexican workers and Mexican employers in Houston, Texas to promote understanding of workers’ rights and responsibilities of employers under the OSH Act, including the use of the OSHA complaint process.

Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication goals:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and links to OSHA’s Web site from the Consulate’s Web site) to Mexican Nationals working in Houston, Texas and their employers.

  • To speak, exhibit, or appear at the Participants’ conferences, local meetings, or other events.

  • To participate in “Mobile Consulate” activities and events.

Promotion of a National Dialogue

The Participants intend to work together to achieve the following goals related to promoting a joint dialogue on workplace safety and health:

  • To raise awareness of and demonstrate commitment to workplace safety and health and workers’ rights under the OSH Act whenever leaders from the Participants address groups.

  • To convene or participate in forums, roundtable discussions, or stakeholder meetings on issues affecting Mexican Nationals working in Houston, Texas to help forge innovative solutions on issues concerning workplace safety and health and understanding of workers’ rights and responsibilities of employers under the OSH Act.

An implementation team made up of representatives of each Participant intends to meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the Participants. In addition, the Participants intend to meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance.

Nothing in this Arrangement commits the Participants to the expenditure of any funds.

This Arrangement may commence upon signature by both Participants. This Arrangement may continue for two (2) years from the date of signing. A Participant should endeavor to provide thirty (30) days advanced written notice of its intent to discontinue the Arrangement. This Arrangement may be modified in writing at any time by mutual consent of the Participants.

Las oficinas del Área Norte y Sur de Houston de la Administración de Seguridad y Salud Ocupacional (OSHA) del Departamento de Trabajo de los Estados Unidos de América y el Consulado de México en Houston, TX (el Consulado), en adelante denominados conjuntamente “los Participantes”;

Capacitación y Educación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de capacitación y educación:

  • Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en Houston, Texas sobre la seguridad y la salud en el lugar de trabajo.

  • Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en Houston, Texas a fin de promover el entendimiento de los derechos de los trabajadores y las responsabilidades de los empleadores al amparo del OSH Act, incluyendo el uso del procedimiento de quejas de OSHA.

Difusión y Comunicación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de difusión y comunicación:

  • Elaborar información sobre el reconocimiento y la prevención de riesgos en el lugar de trabajo, y formular mecanismos para comunicar dicha información (por ejemplo, por medios impresos y electrónicos, herramientas de asistencia electrónica y enlaces al sitio Web de la OSHA desde el sitio Web del Consulado), a los nacionales mexicanos que trabajan en Houston, Texas y a sus empleadores.

  • Dar discursos, realizar exposiciones o presentarse en las conferencias, reuniones locales u otros eventos de los Participantes.

  • Participar en las actividades y los eventos del “Consulado Móvil”.

Promoción de un Diálogo Nacional

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos relacionados con la promoción de un diálogo conjunto sobre la seguridad y la salud en el lugar de trabajo:

  • Dar a conocer y demostrar el compromiso con la seguridad y la salud en el lugar de trabajo y los derechos de los trabajadores siempre que los funcionarios principales de los Participantes se dirijan al público.

  • Convocar o participar en foros, debates en mesas redondas o reuniones de interesados principales sobre cuestiones que afectan a los nacionales mexicanos que trabajan en Houston, Texas para ayudar a forjar soluciones innovadoras sobre cuestiones relativas a la seguridad y la salud en el lugar de trabajo, y el entendimiento los derechos de los trabajadores y las responsabilidades de los empleadores al amparo del OSH Act.

Un grupo de implementación, integrado por representantes de cada Participante, tiene la intención de reunirse para elaborar un plan de acción, determinar los procedimientos de trabajo y establecer las funciones y responsabilidades de los Participantes. Además, los Participantes tienen el propósito de reunirse por lo menos tres veces al año con fines de seguimiento e intercambio de información sobre las actividades y los resultados en torno al logro de los objetivos de la Alianza.

Nada de lo dispuesto en el presente Arreglo compromete a los Participantes a erogar recursos.

Este Arreglo puede iniciarse una vez firmado por los dos Participantes. El presente Arreglo puede durar dos (2) años a partir de la fecha de su firma. El Participante que tenga la intención de dar por terminado el presente Arreglo procurará notificar por escrito al respecto con treinta (30) días de antelación. El presente Arreglo podrá modificarse por escrito en cualquier momento mediante el consentimiento mutuo de los Participantes.

  • To raise awareness of and demonstrate commitment to workplace safety and health and workers' rights under the OSH Act whenever leaders from the Participants address groups.
  • To convene or participate in forums, roundtable discussions, or stakeholder meetings on issues affecting Mexican Nationals working in the State of Oklahoma to help forge innovative solutions on issues concerning workplace safety and health and understanding of workers' rights and responsibilities of employers under the OSH Act.

An implementation team made up of representatives of each Participant intends to meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the Participants. In addition, the Participants intend to meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance.

Nothing in this Arrangement commits the Participants to the expenditure of any funds.

This Arrangement may commence upon signature by both Participants. This Arrangement may continue for two (2) years from the date of signing. A Participant should endeavor to provide thirty (30) days advanced written notice of its intent to discontinue the Arrangement. This Arrangement may be modified in writing at any time by mutual consent of the Participants.

AIMS COMMUNITY COLLEGE

The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) Denver Area Office and Aims Community College recognize the value of establishing a collaborative relationship to foster safety and health practices and programs to improve American workplaces. To that end, OSHA and Aims Community College hereby form an Alliance to provide Aims Community College agricultural students and the public with information, guidance, and access to training resources that will help them protect workers by reducing and preventing exposure to safety and health issues including machine guarding, lockout tagout, dust control/combustible dust and confined space. This alliance will also address student safety training and hazard identification techniques, programs and methods, and the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

This agreement provides a framework and objectives for the Alliance's activities. Alliance participants also agree to meet the "Fundamental Requirements for OSHA Alliance Program Participants" and the "Guidelines for OSHA's Alliance Program Participants: Alliance Products and Other Alliance Projects."

Through the Alliance, the organizations will use available injury, illness, and hazard exposure data, when appropriate, to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options, including but not limited to member surveys, to evaluate the Alliance and measure the impact on improving workplace safety and health. In developing this Alliance, OSHA and Aims Community College recognize that OSHA’s State Plan and On-Site Consultation Program partners are an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be shared with these partners for the advancement of common goals.

Raising Awareness: Outreach and Communication

The Participants intend to work together to achieve the following objectives:

  • Share information on OSHA’s National/Regional/Local Initiatives (Emphasis Programs, Regulatory Agenda, Outreach), and opportunities to participate in initiatives and the rulemaking process.

  • Share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.

  • Develop information on the recognition and prevention of workplace hazards, and communicate such information (e.g., print and electronic media, electronic assistance tools, and OSHA and the Aims Community College websites) to employers and workers in the industry.

  • Speak, exhibit, or appear at OSHA and Aims Community College conferences, local meetings, or other events.

  • Convene or participate in forums, roundtable discussions, or stakeholder meetings on machine guarding, lockout tagout, dust control/combustible dust, confined space, student safety training to help forge innovative solutions in the workplace or to provide input on safety and health issues.

  • Share information among OSHA personnel and industry safety and health professionals regarding Aims Community College good practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum).

Training and Education

The Participants intend to work together to achieve the following objectives:

  • Develop effective training and education programs for Aims Community College constituents and other local employer and employee groups regarding topics including, but not limited to recordkeeping, agriculture, safety and health management program elements, and current OSHA initiatives and to communicate such information to constituent employers and workers.

  • Develop effective training and education programs for Aims Community College constituents and other local employer and employee groups to promote understanding of workers’ rights, including the use of the OSHA complaint process, and the responsibilities of employers and to communicate such information to workers and employers.

  • Deliver or arrange for training events during the term of the agreement. Training may be delivered via webinar, appearances at Aims Community College conferences or OSHA events.

OSHA’s Alliances provide organizations an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA’s initiatives, outreach, communications, training, and education. These Alliances have proven to be valuable tools for both OSHA and Alliance participants. By entering into an Alliance with an organization, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that organization’s products or services.

OSHA team members will include representatives of the Denver Area Office and any other appropriate offices. OSHA will encourage On-Site Consultation program' participation on the team.

The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA), and the North Dakota Safety Council continue to recognize the value of maintaining a collaborative relationship to foster safety and health practices and programs to improve American workplaces. To that end, OSHA and the North Dakota Safety Council hereby renew the Alliance signed February 26, 2020, with a continued emphasis on building a positive safety culture with employers and workers in North Dakota. Specifically, information, training resources, and guidance related to emphasis programs including trench/excavation, falls in construction, grain handling operations, warehousing operations as well as the oil and gas industry throughout the state. Both organizations are committed to providing their members and the public with information, guidance, and access to training resources that will help them protect the health and safety of workers and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act). Through the Alliance, the organizations will continue to address hazards associated falls, trench collapse, grain handling and other high injury industries.

This agreement provides a framework and objectives for the Alliance's activities. Alliance participants also agree to meet the requirements for program participation laid out in the "Fundamental Requirements for OSHA Alliance Program Participants" and the "Guidelines for OSHA's Alliance Program Participants: Alliance Products and Other Alliance Projects."

  • Convene or participate in forums, roundtable discussions, or stakeholder meetings to help forge innovative solutions in the workplace or to provide input on safety and health issues particularly through National and Regional Emphasis Programs.
  • Collaborate with Alliance participants on specific issues and projects on related to national and regional emphasis programs such as oil and gas, grain handling, falls in construction, amputation in general industry and trench/excavation safety.
Training and Education

The Participants intend to work together to achieve the following objectives:

  • To share information among OSHA personnel and industry safety and health professionals regarding best practices or effective approaches through training programs, workshops, seminars, and written materials on agreed upon topics with regard to workplace safety and health.
  • Develop informational products on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and OSHA's and the North Dakota Safety Council's website)
