ARRANGEMENT ESTABLISHING AN ALLIANCE
BETWEEN
THE U.S. DEPARTMENT OF LABOR'S
OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION
PORTLAND AREA OFFICE
AND
THE CONSULATE OF MEXICO IN PORTLAND, OREGON
The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) Portland Area Office and the Consulate of Mexico in Portland, Oregon, hereinafter referred to collectively as "the Participants";
RECOGNIZING the joint commitment to protect workers' rights for Mexican workers in the United States acknowledged in the Letter of Arrangement between the Occupational Safety and Health Administration of the Department of Labor of the United States of America and the Ministry of Foreign Affairs of the United Mexican States, concerning Workplace Safety and Health Protections Applicable to Mexican Workers in the United States, signed at Washington, D.C., on September 2, 2027; and
RECOGNIZING that OSHA's Alliance Program provides for the establishment of cooperative relationships for purposes such as training and education, outreach and communication, and promoting a national dialogue on workplace safety and health;
Intend to form an Alliance to achieve the following:
Overall Objective
The Participants intend to establish a collaborative relationship to provide Mexican nationals and others in 32 counties of Oregon: Benton, Clackamas, Clatsop, Columbia, Coos, Crook, Curry, Deschutes, Douglas, Gilliam, Grant, Harney, Hood River, Jackson, Jefferson, Josephine, Klamath, Lake, Lane, Lincoln, Linn, Marion, Morrow, Multnomah, Polk, Sherman, Tillamook, Umatilla, Wasco, Washington, Wheeler and Yamhill, information, guidance, and access to education and training resources to promote workers' rights in protecting their occupational safety and health, and to help them understand U.S. domestic law on the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).
Training and Education
The Participants intend to work together to achieve the following training and education goals:
- To develop training and education programs for Mexican workers and Mexican employers in 32 counties of Oregon regarding workplace safety and health.
- To develop training and education programs for Mexican workers and Mexican employers in 32 counties of Oregon to promote understanding of workers' rights and responsibilities of employers under the OSH Act, including the use of the OSHA complaint process.
Outreach and Communication
The Participants intend to work together to achieve the following outreach and communication goals:
- To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and links to OSHA's Web site from the Consulate's Web site) to Mexican nationals working in 32 counties of Oregon and their employers.
- To speak, exhibit, or appear at the Participants' conferences, local meetings, or other events.
- To participate in "Mobile Consulate" activities and events.
Promotion of a National Dialogue
The Participants intend to work together to achieve the following goals related to promoting a joint dialogue on workplace safety and health:
- To raise awareness of and demonstrate commitment to workplace safety and health and workers' rights under the OSH Act whenever leaders from the Participants address groups.
- To convene or participate in forums, roundtable discussions, or stakeholder meetings on issues affecting Mexican nationals working in 32 counties of Oregon to help forge innovative solutions on issues concerning workplace safety and health and understanding of workers' rights and responsibilities of employers under the OSH Act.
An implementation team made up of representatives of each Participant intends to meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the Participants. In addition, the Participants intend to meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance.
Nothing in this Arrangement commits the Participants to the expenditure of any funds.
This Arrangement may commence upon signature by both Participants. This Arrangement may continue for two (2) years from the date of signing. A Participant should endeavor to provide thirty (30) days advanced written notice of its intent to discontinue the Arrangement. This Arrangement may be modified in writing at any time by mutual consent of the Participants.

AGREEMENT ESTABLISHING AN ALLIANCE
BETWEEN
THE WILKES-BARRE AREA OFFICE OF
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION
U.S. DEPARTMENT OF LABOR
AND
NORTHEASTERN PENNSYLVANIA INDUSTRIAL RESOURCE CENTER (NEPIRC)
The U.S. Department of Labor’s Occupational Safety and Health Administration’s (OSHA) Wilkes-Barre Area Office and the Northeastern Pennsylvania Industrial Resource Center (NEPIRC) recognize the value of establishing a collaborative relationship to foster safety and health practices and programs to improve American workplaces. To that end, OSHA and NEPIRC (hereafter known as the Participants) hereby form an Alliance to provide NEPIRC stakeholders and others with information, guidance, and access to training resources that will help them protect the health and safety of workers. In particular, the Alliance will focus on: reducing and preventing exposure to emerging general industry hazards; addressing safety programs including hazard recognition and control and injury and illness prevention; making safety training more effective; and, understanding the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).
This agreement provides a framework and objectives for the Alliance's activities. Alliance participants also agree to meet the "Fundamental Requirements for OSHA Alliance Program Participants" and the "Guidelines for OSHA's Alliance Program Participants: Alliance Products and Other Alliance Projects."
Through the Alliance, the participants may use available injury, illness, and hazard exposure data when appropriate, to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options, including but not limited to member surveys, to evaluate the Alliance and measure the impact on improving workplace safety and health. In developing this Alliance, OSHA and NEPIRC recognize that OSHA’s State Plan and On-Site Consultation Program partners are an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be shared with these partners for the advancement of common goals.
Raising Awareness: Outreach and Communication
The Participants intend to work together to achieve the following objectives:

Share information on OSHA’s National/Regional/Local Initiatives, and opportunities to participate in the rulemaking process.

Share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.
-
Speak, exhibit, or appear at OSHA and NEPIRC conferences, local meetings, and safety day events, and share information on OSHA special initiative outreach campaigns such as Safe + Sound.

Convene or participate in forums, roundtable discussions, or stakeholder meetings on general industry hazards, work and life wellness programs, and emergency preparedness to help forge innovative solutions in the workplace or to provide input on safety and health issues.

Develop pathways to communicate information regarding the recognition and prevention of workplace hazards to employers and workers in the industry.

Encourage worker participation in workplace safety and health by training employers on how to involve employees in Job Hazard Analysis (JHAs) and hazard identification initiatives in the workplace to include the effectiveness of employee-based workplace safety committees.
Training and Education
The Participants intend to work together to achieve the following training and education objectives, as the opportunities or resources permit:

Develop effective training and education programs for NEPIRC stakeholders and others regarding general industry hazards, emergency preparedness, and work and life wellness programs, and communicate such information to constituent employers and workers.

Deliver or arrange for the delivery of such courses as: Two-Hour Workplace Safety Seminars, Forklift Safety, Hazard Identification/Job Hazard Analysis, Conducting Safety Audits, Personal Protective Equipment, and Safety Committee Operations.

Develop and update safety audit checklist to distribute to stakeholders to assist them on internal safety audits.

Deliver effective training and education programs for NEPIRC stakeholders and others to promote understanding of workers’ rights, including the use of the OSHA complaint process and the responsibilities of employers, and to communicate such information to workers and employers.
OSHA’s Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA’s initiatives, outreach, communications, training, and education. These Alliances have proved to be valuable tools for both OSHA and Alliance participants. By entering into an Alliance with an organization, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that organization’s products or services.
An implementation team made up of representatives of each organization will meet one to two times per year to track and share information on activities and results in achieving the goals of the Alliance. OSHA team stakeholders will include representatives of the Wilkes-Barre Area Office and any other appropriate offices. OSHA will encourage State Plans' and OSHA On-Site Consultation programs' participation on the team.
This agreement will remain in effect for two years. Any signatory may terminate it for any reason at any time, provided they give 30 days’ written notice. This agreement may be modified at any time with the written concurrence of both signatories.

La Administración de Salud y Seguridad Ocupacional del Departamento de Trabajo de los EE. UU. (OSHA), Oficina del Área de Boston Sur, la Oficina del Área de Providence y el Centro Comunitario de Trabajadores (CCT) reconocen el valor de establecer una relación de colaboración para fomentar prácticas y programas de seguridad y salud para mejorar lugares de trabajo estadounidenses. Con ese fin, OSHA y CCT por el presente forman una Alianza con énfasis en abordar los peligros para la seguridad y la salud en el lugar de trabajo que enfrenta el electorado de trabajadores inmigrantes y de bajos salarios de CCT en el sur de Nueva Inglaterra, además de comprender los derechos de estos trabajadores y las responsabilidades de empleadores bajo la Ley de Seguridad y Salud Ocupacional (Ley OSH).
Este acuerdo proporciona un marco y objetivos para las actividades de la Alianza. Los participantes de la Alianza también aceptan cumplir con los "Requisitos Fundamentales para los Participantes del Programa de la Alianza de la OSHA" y las " Directrices para los Participantes del Programa de la Alianza de OSHA: Productos de la Alianza y Otros Proyectos de la Alianza".
A través de Alliance, los participantes utilizarán datos relevantes sobre lesiones, enfermedades y exposición a peligros, cuando corresponda, para ayudar a identificar áreas de énfasis para las actividades de comunicación, difusión y concientización de Alliance. La Alianza también explorará e implementará opciones seleccionadas para evaluar la eficacia de la Alianza y medir el impacto de su esfuerzo general para mejorar la seguridad y la salud en el lugar de trabajo. Al desarrollar esta Alianza, OSHA y CCT reconocen que los socios del Proyecto de Consulta en el Sitio y el Plan Estatal de OSHA son una parte integral del esfuerzo nacional de OSHA, y que la información sobre los productos y actividades de la Alianza puede compartirse con estos socios para el avance de objetivos comunes.
Concienciación: Alcance y Comunicación
Los participantes tienen la intención de trabajar juntos para lograr los siguientes objetivos relacionados con la creación de conciencia sobre las iniciativas de reglamentación y ejecución de OSHA:

Compartir información sobre las Iniciativas Nacionales/Regionales/Locales de OSHA (Programas de Énfasis, Agenda Reguladora, Divulgación) y oportunidades para participar en iniciativas y el proceso de reglamentación.

Compartir información sobre las leyes y normas de seguridad y salud en el trabajo, incluidos los derechos y responsabilidades de los trabajadores y los empleadores.
-
Compartir información sobre los derechos como empleado bajo las leyes de protección de denunciantes impuestas por OSHA y la importancia de presentar quejas de inmediato si alguien cree que ha sido objeto de represalias por ejercer esos derechos.
-
Hablar, exhibir o aparecer en conferencias, reuniones locales u otros eventos de OSHA y CCT.
-
Convoque o participe en foros, mesas redondas o reuniones de partes interesadas sobre trabajadores inmigrantes y de bajos salarios para ayudar a forjar soluciones innovadoras en el lugar de trabajo o para proporcionar información sobre temas de seguridad y salud.

Fomentar la participación de los trabajadores en la seguridad y la salud en el lugar de trabajo, independientemente de su estatus migratorio, y establecer relaciones con las oficinas regionales y de áreas de OSHA para abordar los problemas de salud y seguridad que enfrentan los trabajadores inmigrantes y de bajos salarios.

Compartir información entre el personal de OSHA y los profesionales de seguridad y salud de la industria con respecto a las mejores prácticas o enfoques efectivos del Centro Comunitario de Trabajadores a través de programas de capacitación, talleres, seminarios y conferencias u otros foros desarrollados por los participantes.

Colaborar con otros participantes de la Alianza en temas y proyectos específicos sobre la prevención de peligros en el lugar de trabajo para los trabajadores inmigrantes que se abordan y desarrollan a través del Programa de la Alianza.

Desarrollar y difundir estudios de casos sobre las dificultades y estrategias específicas que se han encontrado efectivas para prevenir los peligros que enfrentan los inmigrantes y dar a conocer sus resultados.
Formación y Educación
Los Participantes tienen la intención de trabajar juntos para lograr los siguientes objetivos de formación y educación:

Desarrollar programas efectivos de capacitación y educación sobre los peligros para la salud y la seguridad en el lugar de trabajo que experimentan los miembros de CCT y comunicar dicha información a los empleadores y trabajadores constituyentes de una manera cultural y lingüísticamente apropiada.
-
Desarrollar programas de capacitación y educación efectivos para los miembros de CCT que sean culturalmente y lingüísticamente apropiados para promover la comprensión de los derechos de los trabajadores, incluido el uso del proceso de quejas de OSHA y las responsabilidades de los empleadores.
Las alianzas de OSHA brindan a las organizaciones la oportunidad de participar en una relación de cooperación voluntaria con OSHA con fines tales como crear conciencia sobre las iniciativas, divulgación, comunicaciones, capacitación y educación de OSHA. Estas Alianzas han demostrado ser herramientas valiosas tanto para OSHA como para los participantes de la Alianza. Al entrar en una alianza con una organización, OSHA no respalda ni promueve, ni tiene la intención de respaldar o promover, ninguno de los productos o servicios de esa organización.
Un equipo de implementación compuesto por representantes de cada organización se reunirá una o dos veces al año para realizar un seguimiento y compartir información sobre las actividades y los resultados para lograr los objetivos de la Alianza. Los miembros del equipo de OSHA incluirán representantes de la Oficina del Área de Boston Sur y la Oficina del Área de Providence, junto con cualquier otra oficina apropiada. OSHA fomentará la participación a los Estados de Planes Estatales y Proyectos de Consulta In Situ en el equipo de los proyectos.
Este acuerdo tendrá una vigencia de dos años. Cualquier signatario puede rescindirlo por cualquier motivo en cualquier momento, siempre que el signatario que rescinda dé aviso por escrito al otro con 30 días de antelación. Este acuerdo puede ser modificado en cualquier momento con el consentimiento por escrito de todos los signatarios.
