1 The Georgia Farmworker Task Force is an advocacy group lead by the Farmworker Rights Division of the Georgia Legal Services. They advocate and represent farmworkers who are working and living unsafely because their employer is violating regulations in place to protect them. This group visits farms to inform workers of their rights; they also provide legal representation and inform the members of potential violations of existing laws. The Federal Agencies belonging to this group are there to provide resources and clarification of their regulations/jurisdictions/limitations and the non-profit organizations and Consulates are usually receiving employees’ complaints because the workers feel more comfortable speaking to them than a government agency.

      The Occupational Safety and Health Administration (OSHA) and the Consul General of Mexico in Atlanta, Georgia, formed an Alliance to provide Mexican workers throughout the southeast with information, guidance, and access to training resources that will help them protect employees’ health and safety and allow them to exercise their rights fully.

El Consulado General de Mexico en Miami, Florida ("el Consulado") y la Oficina del Area de Fort Lauderdale de la Administración de Seguridad y Salud Ocupacional ("OSHA") del Departamento de Trabajo de las Estados Unidos de America, en adelante denominados conjuntamente "las Participantes";

RECONOCIENDO el compromiso conjunto de proteger las derechos de las trabajadores mexicanos en las Estados Unidos; y

RECONOCIENDO que el Programa de Alianza de la OSHA preve el establecimiento de relaciones de cooperación para fines tales coma la capacitación y la educación, difusión y comunicación, y para promover un dialogo nacional sabre la seguridad y la salud en el trabajo;

Se proponen establecer una Alianza para lograr lo siguiente

Objetivo General

Los Participantes tienen la intención de establecer una relación de colaboración para proveer a las nacionales mexicanos y a otros, en las condados de Florida donde ambos Participantes tengan jurisdicción, información, orientación y acceso a recursos de capacitación y educación para promover las derechos de las trabajadores a la protección de su seguridad y salud ocupacionales, y para ayudarlos a entender la ley nacional de las Estados Unidos de America sabre las derechos de las trabajadores y las responsabilidades de las empleadores al amparo de la Ley de Seguridad y Salud Ocupacionales (OSH Act).

Capacitación y Educación

Los Participantes tienen la intención de trabajar conjuntamente para lograr las siguientes objetivos de capacitación y educación:

  • Elaborar programas de capacitación y educación para las empleadores y las trabajadores mexicanos en las condados de Florida donde ambos Participantes tengan jurisdicción, sobre la seguridad y la salud en el lugar de trabajo.
  • Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en los condados de Florida donde ambos Participantes tengan jurisdicción a fin de promover el entendimiento de los derechos de los trabajadores y las responsabilidades de los empleadores al amparo del OSH Act, incluyendo el uso del procedimiento de quejas de OSHA.

Difusión y Comunicación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de difusión y comunicación:

  • Elaborar información sobre el reconocimiento y la prevenclón de 0 riesgos en el lugar de trabajo, y formular mecanismos para comunicar dicha información (por ejemplo, por medias impresos y electrónicos, herramientas de asistencia electrónica y enlaces al sitio Web de la OSHA desde el sitio Web del Consulado), a los nacionales mexicanos que trabajan en los condados de Florida donde ambos Parlicipantes tengan jurisdicción ya sus empleadores.
  • Dar discursos, realizar exposiciones o presentarse en las conferencias, reuniones locales u otros eventos de los Participantes.
  • Participar en las actividades y los eventos del “Consulado Móvil”.

Promoción de un Diálogo Nacional

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos relacionados con la promoción de un diálogo conjunto sobre la seguridad y la salud en el lugar de trabajo:

  • Dar a conocer y demostrar el compromiso con la seguridad y la salud en el lugar de trabajo y los derechos de los trabajadores siempre que los funcionarios principales de los Participantes se dirijan al público.
  • Convocar o participar en foros, debates en mesas redondas o reuniones de interesados principales sobre cuestiones que afectan a los nacionales mexicanos que trabajan en Miami, Florida y la jurisdicción de los Participantes para ayudar a forjar soluciones innovadoras sobre cuestiones relativas a la seguridad y la salud en el lugar de trabajo, y el entendimiento los derechos de los trabajadores y las responsabilidades de los empleadores al amparo del OSH Act.

Un grupo de implementación, integrado por representantes de cada Participante, tiene la intención de reunirse para elaborar un plan de acción, determinar los procedimientos de trabajo y establecer las funciones y responsabilidades de los Participantes. Además, los Participantes tienen el propósito de reunirse por lo menos tres veces al año con fines de seguimiento e intercambio de información sobre las actividades y los resultados en torno al logro de los objetivos de la Alianza.

Nada de lo dispuesto en el presente Arreglo compromete a los Participantes a erogar recursos.

Este Arreglo puede iniciarse una vez firmado por los dos Participantes. El presente Arreglo puede durar dos (2) años a partir de la fecha de su firma. El Participante que tenga la intención de dar por terminado el presente Arreglo procurará notificar por escrito al respecto con treinta (30) días de antelación. El presente Arreglo podrá modificarse por escrito en cualquier momento mediante el consentimiento mutuo de los Participantes.

The Consulate General of Mexico in Miami, Florida ("the Consulate") and The U.S.Department of Labor's Occupational Safety and Health Administration ("OSHA") Fort Lauderdale Area Office, hereinafter referred to collectively as "the Participants";

RECOGNIZING the joint commitment to protect workers' rights for Mexican workers in the United States;

RECOGNIZING that OSHA's Alliance Program provides for the establishment of cooperative relationships for purposes such as training and education, outreach and communication, and promoting a national dialogue on workplace safety and health;

Intend to form an Alliance to achieve the following:

Overall Objective

The Participants intend to establish a collaborative relationship to provide Mexican Nationals and others, in counties where participants have jurisdiction, information, guidance, and access to education and training resources to promote workers' rights in protecting their occupational safety and health, and to help them understand U.S. domestic law on the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

Training and Education

The Participants intend to work together to achieve the following training and education goals:

  • To develop training and education programs for Mexican workers and Mexican employers in counties where participants have jurisdiction regarding workplace safety and health.
  • To develop training and education programs for Mexican workers and Mexican employers in counties where participants have jurisdiction to promote understanding of workers' rights and responsibilities of employers under the OSH Act, including the use of the OSHA complaint process.

Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication goals:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and links to OSHA's Web site from the Consulate's Web site) to Mexican Nationals working in counties where participants have jurisdiction and their employers.
  • To speak, exhibit, or appear at the Participants' conferences, local meetings, or other events.
  • To participate in "Mobile Consulate" activities and events.

Promotion of a National Dialogue

The Participants intend to work together to achieve the following goals related to promoting a joint dialogue on workplace safety and health:

  • To raise awareness of and demonstrate commitment to workplace safety and health and workers' rights under the OSH Act whenever leaders from the Participants address groups.
  • To convene or participate in forums, roundtable discussions, or stakeholder meetings on issues affecting Mexican Nationals working in counties where participants have jurisdiction to help forge innovative solutions on issues concerning workplace safety and health and understanding of workers' rights and responsibilities of employers under the OSH Act.

An implementation team made up of representatives of each Participant intends to meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the Participants. In addition, the Participants intend to meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance.

Nothing in this Arrangement commits the Participants to the expenditure of any funds.

This Arrangement may commence upon signature by both Participants. This Arrangement may continue for two (2) years from the date of signing. A Participant should provide thirty (30) days advanced written notice of its intent to discontinue the Arrangement. This Arrangement may be modified in writing at any time by mutual consent of the Participants.

    On August 9, 2021, the EKU - OTIEC conducted the OTI course 7500 – Safety and Health Management in support of the OSHA Safe + Sound Campaign. The total attendance for these events was 23 attendees.

    During this period, the USF - OTIEC conducted several events to promote OSHA initiatives including the following: Worker’s Memorial Day, National Fall Safety Stand-Down, and Safe + Sound Week. The total attendance for these events were 259 attendees.

    During this period, the Region IV – OTIEC’s conducted the following activities to train and educate federal and private sector workers regarding COVID-19:

    On 2/25/2021, the Southeastern OTIEC at NCSU conducted a one-hour webinar regarding OSHA guidance for COVID-19.

    During this period, the EKU - OTIEC conducted 13 courses, which were updated with COVID-19 recordkeeping guidance.

    Georgia Tech OTIEC conducted a presentation for the Georgia Manufacturers Extension Partnership – Regional Managers regarding the OSHA COVID-19 NEP (National Emphasis Program).

    The Southeastern OTIEC at UT developed the Coronavirus Resource Dashboard for employers, as well as a booklet titled “Return to work and Recovery Guide.” The OTIEC also updated several courses to address COVID-19.

    During this period, the USF - OTIEC conducted the following events to educate workers and employers about COVID-19: the webinar SAR CoV2 for Healthcare Workers - Qualitative Fit Testing, as well as the webinar Managing Stress and Coping During COVID-19. The total attendance for these events was 174 attendees.

    During this period, the UA - OTIEC conducted 10 training sessions focused on COVID-19, OSHA’s Emergency Temporary Standard (ETS) and infectious diseases.

    During this period, the VSCC - OTIEC conducted the following the OTI Courses: OTI 7210 for Pandemic Illness Preparedness, and OTI 7210 - Pandemic Influenza Preparedness. The latter course was conducted for seven members of Wilson Works, a division of the Wilson County Chamber of Commerce.

      The Occupational Safety and Health Administration (OSHA) and the Associated Builders and Contractors, Inc., Florida Gulf Coast Chapter (ABC) agreed to establish an Alliance to reduce and prevent employee exposure to health and safety hazards, such as, falls, trenching and excavation, scaffolds, confined space, struck-by, chemical and electrical hazards in construction by developing and sharing information, guidance, and training resources.
