Investigation Summary
At 01:38 p.m. on August 06, 2019, an employee was engaged in agriculture related operations for the University of CA system. Three coworkers assisted the employee in operations including pulling weeds in a tomato row in Field 47 at the Agriculture & Natural Resources location in Irvine, CA. The employee was working seasonally. The employee was struck by a Kubota 4 by 4 Diesel Utility Terrain Vehicle while working in Field 47 performing weed abatement. At 05:07 p.m. on August 06, 2019, the employer reported the incident to DOSH. At 08:30 a.m. on September 20, 2019, DOSH arrived on site to conduct an investigation of the incident. At the time of the incident, the employee was performing weed abatement approximately 20 feet from an access road with their back facing the road. The employee had taken the Kubota to travel approximately 0.25 miles to the nearest portable restroom located in between fields. The employee along with two coworkers were working in the Field 47 within 100 feet of each other. The employee was returning from a bathroom break in the Kubota and approached the field, preparing to park. The employee's right boot got stuck underneath the break pedal, causing it to remain depressed on the gas pedal. In an effort to avoid striking a pipe and/or tank located in the area where the employee was attempting to park, the employee turned into the field where the rows caused the UTV to bounce laterally. The employee could not pull his boot free without depressing the gas pedal further, which accelerated the vehicle. The employee was struck, sustaining fractures to the pelvis, shoulder, and three ribs. The employee was transported to Western Medical Center and admitted for treatment.
