Investigation Summary
At 11:50 am on December 9, 2015, a crew of 12 to 15 employees of an asphalt paving contractor were paving a rural single lane road running parallel to a single railroad track with a perpendicular road across the track. Dump trucks were backing from a highway onto a side road to deliver new asphalt to the paving crew. Truck drivers had to back up because turning around in the church parking lot nearby would cause damage to the lot and the employer would be responsible for repairs. Employee #1 was backing a dump truck over the railroad on the narrow single lane road and was struck on the passenger side by a train traveling 36 mph. Employees saw the train coming around a bend towards the truck and tried to get the attention of the truck driver. The train blew the horn two times, but it is believed the driver was not able to hear the horn over the truck's engine. The train struck the dump truck on the passenger side and pushed the truck approximately 40 feet before stopping. The employee was killed from blunt force trauma from the impact of the train.
