Subject: Benzidine-Based Dyes: Direct Black 38, Direct Brown 95 and Direct Blue 6 Dyes

A. Purpose. This instruction provides guidelines to follow when issuing citations under Section 5(a)(1) of the Act, and pertinent standards of a general nature, for employee exposure to Direct Black 38, Direct Brown 95 and Direct Blue 6 benzidine-based dyes.

B. Scope. This instruction applies OSHA-wide.

C. Action. OSHA Regional Administrators/Area Directors shall assure that:

Sampling for benzidine congener dyes

OSHA requirements are set by statute, standards and regulations. Our interpretation letters explain these requirements and how they apply to particular circumstances, but they cannot create additional employer obligations. This letter constitutes OSHA's interpretation of the requirements discussed. Note that our enforcement guidance may be affected by changes to OSHA rules.
