      Alliance between the United States Department of Labor's Occupational Safety and Health Administration and the Consulate General of Mexico was established as a collaborative relationship to provide Mexican Nationals and others in El Paso and Counties covered by the Consulate information, guidance, and access to education and training resources to promote workers' rights in protecting their occupational safety and health, and to help them understand U.S. domestic law on the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

AGREEMENT RENEWING AN ALLIANCE
BETWEEN
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION

AND
WORKERS DEFENSE PROJECT


The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) Austin Area office and Workers Defense Project continue to recognize the value of maintaining a collaborative relationship to foster safety and health practices and programs to improve American workplaces. To that end, OSHA and Workers Defense Project hereby renew the Alliance signed August 22, 2014 and renewed August 30, 2016, with a continued emphasis on Hispanic construction worker safety. Specifically, both organization(s) are committed to providing Workers Defense Project members and others with information, guidance, and access to training resources that will help them protect workers and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act). Through the Alliance, the organizations will continue to address immigrant worker safety in construction.

This agreement provides a framework and objectives for the Alliance's activities. Alliance participants also agree to meet the requirements for program participation laid out in the "Fundamental Requirements for OSHA Alliance Program Participants" and the "Guidelines for OSHA's Alliance Program Participants: Alliance Products and Other Alliance Projects."

Through the Alliance, the organizations will use injury, illness, and hazard exposure data, when appropriate, to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options, including but not limited to member surveys, to evaluate the effectiveness of the Alliance and measure the impact of its overall effort on improving workplace safety and health. In renewing this Alliance, OSHA and Workers Defense Project recognize that OSHA's State Plan and On-Site Consultation Project partners are an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be shared with these partners for the advancement of common goals.

Raising Awareness: Outreach and Communication

The Participants intend to work together to achieve the following objectives:

  • To share information on OSHA's National/Regional/Local Initiatives (Emphasis Programs, Regulatory Agenda, Outreach), and opportunities to participate in initiatives and the rulemaking process.
  • To share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.
  • To speak and appear at Workers Defense Project local meetings.
  • To share information among OSHA personnel and industry safety and health professionals regarding Workers Defense Project good practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum).
  • To encourage worker participation in workplace safety and health by informing Hispanic workers of their rights under OSHA.
  • To collaborate with other Alliance participants on specific issues and projects on construction worker safety.
  • To encourage Workers Defense Project to build relationships with OSHA's Regional and Area Offices to address health and safety issues, including worker's rights and construction safety.

Training and Education

The Participants intend to work together to achieve the following objectives:

  • To develop effective training and education programs for construction workers regarding the focus four hazards, and to communicate such information to constituent employers and workers.
  • To develop effective training and education programs for construction workers to promote understanding of workers' rights, including the use of the OSHA complaint process, and the responsibilities of employers and to communicate such information to workers and employers.

OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA's initiatives, outreach, communication, training, and education. These Alliances have proven to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that party's products or services.

An implementation team made up of representatives of each organization will meet one to two times per year to track and share information on activities and results in achieving the goals of the Alliance. OSHA team members will include representatives of the Austin Area Office and any other appropriate offices. OSHA will encourage State Plan States' and OSHA On-Site Consultation Projects' participation on the team.

This agreement will remain in effect for three years. Either signatory may terminate it for any reason at any time, provided they give 30 days' written notice. This agreement may be modified at any time with the written concurrence of both signatories.

    3. Overview

      The Greater Baton Rouge Chapter of the American Society of Safety Engineers is a non-profit organization that was founded in September 1957. The current membership is comprised of over 400 safety professionals who represent employers from various industries such as construction, refinery, chemical, heath care, insurance, and governmental agencies. Within the last year, the American Society of Safety Engineers organization has officially changed their name to the American Society of Safety Professionals.

      The Occupational Safety and Health Administration (OSHA), Baton Rouge Area Office and Greater Baton Rouge Chapter, ASSE (GBRC-ASSE) set out to form an Alliance in order to provide Chapter members and others with information, guidance, and access to training resources that will help foster employee health and safety, particularly in reducing and preventing exposure including, but not limited to: fall hazards, trenching/excavations, combustible dusts, and struck-by hazards.

The Participants intend to work together to achieve the following training and education goal:

  • To develop effective training and education programs for construction workers regarding focus four hazards, and to communicate such information to constituent employers and workers.
  • To develop effective training and education programs for construction workers to promote understanding of workers’ rights, including the use of the OSHA complaint process, and the responsibilities of employers and to communicate such information to workers and employers.

Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication goals:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and OSHA’s and the Workers Defense Project’s web sites) to employers and workers in the industry.
  • To speak, exhibit, or appear at OSHA’s or Workers Defense Project local meetings, or other events.
  • To share information between OSHA personnel and industry safety and health professionals regarding Workers Defense Project good practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum) developed by the participants.

OSHA’s Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA’s rulemaking and enforcement initiatives, training and education, and outreach and communication. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that party’s products or services.

An implementation team made up of representatives of each organization will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance. OSHA team members will include representatives of the Austin Area Office and any other appropriate offices. OSHA will encourage State Plan States’ and OSHA On-site Consultation Projects’ participation on the team.

This agreement will remain in effect for 2 years. Either signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the written concurrence of both signatories.

Overall Objective

The Participants intend to work together to achieve the following outreach and communication goals:

The Participants intend to work together to achieve the following goals related to promoting a joint dialogue on workplace safety and health:

  • To convene or participate in forums, roundtable discussions, or stakeholder meetings on issues affecting Mexican Nationals working in Eastern Texas to help forge innovative solutions on issues concerning workplace safety and health and understanding of workers’ rights and responsibilities of employers under the OSH Act.

An implementation team made up of representatives of each Participant intends to meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the Participants. In addition, the Participants intend to meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance.

Nothing in this Arrangement commits the Participants to the expenditure of any funds.

This Arrangement may commence upon signature by both Participants. This Arrangement may continue for two (2) years from the date of signing. A Participant should endeavor to provide thirty (30) days advanced written notice of its intent to discontinue the Arrangement. This Arrangement may be modified in writing at any time by mutual consent of the Participants.

The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA), The Oklahoma Department of Labor (ODOL), OSHA Consultation Division, and The Associated General Contractors of Oklahoma Building Chapter (AGCOK) recognize the value of establishing a collaborative relationship to foster safer and more healthful American workplaces. Through the Alliance, the organizations will use relevant injury, illness and hazard exposure data when appropriate to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options to evaluate the effectiveness of the Alliance and measure the impact of its overall effort on improving workplace safety for employers and workers. In developing this Alliance, OSHA and AGCOK recognize that OSHA's On-site Consultation Project partners are an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be shared with these partners for the advancement of common goals.

    3. Overview

      The Alliance with the Associated Builders and Contractors (ABC), Pelican Chapter was established to create a collaborative relationship to foster safer and more healthful workplaces. The goals of the Alliance are to be achieved through sharing information, providing guidance, and access to training resources to protect employees' health and safety. Particular focus is to be paid to reducing and preventing exposure to struck-by, falls, caught-in-between and electrical hazards and addressing construction and industrial contractor issues.

      ABC is a national trade association with 72 chapters representing 22,000 members representing more than 19,000 construction and industry-related firms. The ABC, Pelican Chapter was incorporated and developed in April 1980, around the need to adequately service the construction industry throughout Louisiana.

      The Chapter's Safety Committee is responsible for continually updating the membership on any new or revised standards and regulations, to provide oversight and review on all Pelican Chapter safety training, to promote the ABC National Safety Training and Evaluation Process (STEP) Awards program, and to maintain the Alliance with OSHA. The Pelican Chapter Safety Committee comprises the largest concentration of contractor safety professionals in the region, and through the Alliance has a mission of supporting the industry through outreach efforts.

  4. Evaluations

    The ABC, Pelican Chapter's campus location in Baton Rouge was severely impacted by a prolonged rainfall that resulted in catastrophic flooding for areas of South Louisiana, August 12, 2016 through August 22, 2016. Despite the numerous setbacks and hardships caused by the event, the Alliance resumed activities during the evaluation period, continuing to focus on training and education along with outreach and communication.

      The Greater Baton Rouge Chapter of the American Society of Safety Engineers (ASSE) is a non-profit organization that was founded in September 1957. Discussions occurred by face-to-face meeting, telephone, and e-mail communications. The implementation team also addressed attendees of the monthly general membership meetings that were held at various locations in the Greater Baton Rouge Area.

    Events

    • The Chapter hosted a "Bring-A-Worker" event at an ASSE meeting featuring safety at the workplace.
    • The Chapter Board members participated in the Louisiana Governor's Safety and Health Conference to promote membership, safety education, and safety certification. Interest was solicited for planned safety certification preparatory workshops for the construction-based designation of Construction Health and Safety Technician (CHST) offered by the Board of Certified Safety Professionals.
    • The Chapter president participated in education forums at Southeastern University with emphasis on OSHA 300 log and workplace safety.
    • Chapter Board members also participated in several other safety-training workshops and served in various capacities within the safety communities at the local, state, and national levels, including various industries.

    Outreach and Communication

    Events

    • Regular compliance updates were provided by the OSHA, Baton Rouge Area Office including occasional appearances at monthly membership meetings to discuss the latest regulatory information.
    • The Chapter holds monthly general meetings including guest speakers who discussed topics concerning Health, Safety or Environmental issues and/or current events.
    • The Chapter officers and local OSHA representatives generate informative Emails, newsletters, and Safety Alerts that are distributed to Chapter Membership, Guests and Professional Colleagues.
    • The Chapter continues to participate in the safety in the workplace where volunteers discuss and promote workplace safety.
    • Personal Protective Equipment (PPE) was donated to "Cenikor" a foundation that promotes helping people deal with behavioral health issues and chemical dependency, changing lives for those entering or returning to the workplace.

    Promoting the National Dialogue on Workplace Safety and Health

    Events

    • Members of the Greater Baton Rouge Chapter ASSE Executive Board and General Membership continue to foster relationships and shared ideas through their involvement with other professional association safety committees including but not limited to: Associated Builders and Contractors, Pelican Chapter; Safety Council of Louisiana; Greater Baton Rouge Industry Alliance; ANSI/ASSE Z-59 Fall Protection Standard Advisory Committee; Southeastern Louisiana University, Occupational Safety &Health Curriculum Advisory Steering Committee; and the National Petroleum &Refining Association National Safety Committee.
    • Joint Membership meetings were also held with the American Industrial Hygiene Association, and the Bayou Chapter ASSE. The OSHA, Baton Rouge Area Office's, Area Director conducted a presentation at a Chapter meeting on familiarity with the Silica Standards.
    • The Greater Baton Rouge Chapter ASSE annually recognizes Workers' Memorial Day and communicates related information to member organizations.
  4. Results

    The Greater Baton Rouge Chapter ASSE Members continue to have access to a greater amount of educational information and are made aware of OSHA's on-going efforts to reach at-risk industries by sharing current events, safety alerts and best practices.

    As with the previous year, the OSHA, Baton Rouge Area Office Compliance Assistance Specialist (CAS) provided OSHA Update presentations and gave presentations at various member workplaces. The CAS provided literature which included educational brochures, pamphlets and training materials. Topics provided but were not limited to: Fall Protection, Heat Stress, Process Safety Management and Emergency Preparedness.

  5. Upcoming Milestones

    The OSHA, Baton Rouge Area Office and the Greater Baton Rouge Chapter ASSE will continue to work together through the Alliance to provide employers, employees and the public with information targeted at the individual worker. Specifically, the chapter will continue to host the "Bring-a-Worker" meetings were members invite their employees to attend, in addition to other outreach efforts. Efforts will continue in the creation of local opportunities for professional development in order to assist employers in work-related injury reduction, and particularly serious injuries and fatalities.

The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) El Paso Area Office and El Paso Community College – Risk Management Institute recognize the value of establishing a collaborative relationship to foster safer and more healthful American workplaces. To that end, OSHA and El Paso Community College – Risk Management Institute hereby form an Alliance to provide El Paso Community College – Risk Management Institute students and others with information, guidance, and access to training resources that will help them protect the health and safety of workers, particularly by reducing and preventing exposure to falls, electrocution, struck-by, caught-in or between and addressing construction and general industry issues, and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

This agreement provides a framework and objectives for the Alliance's activities. Alliance participants will summarize specific activities and timeframes for completion in a written work plan.

Through the Alliance, the organizations will use relevant injury, illness and hazard exposure data when appropriate to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options to evaluate the effectiveness of the Alliance and measure the impact of its overall effort on improving workplace safety for employers and workers. In developing this Alliance, OSHA and El Paso Community College – Risk Management Institute recognize that OSHA's State Plan and On-site Consultation Project partners are an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be shared with these partners for the advancement of common goals.

Raising Awareness of OSHA's Rulemaking and Enforcement Initiatives

The Participants intend to work together to achieve the following objectives related to raising awareness of OSHA's rulemaking and enforcement initiatives:

  • To share information on occupational safety and health laws and standards, such as falls, electrocution, struck-by, caught-in or between and heat illness hazards including the rights and responsibilities of workers and employers.
  • To convene or participate in forums, roundtable discussions, or stakeholder meetings on safety and health issues to help forge innovative solutions in the workplace or to provide input on construction and general industry safety and health issues.

Training and Education

The Participants intend to work together to achieve the following training and education objectives:

  • To deliver or arrange for the delivery of OSHA 10 and 30 Hour courses and other Safety and Health courses in English and Spanish.

Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication objectives:

  • To speak, exhibit, or appear at OSHA's or El Paso Community College conferences, local meetings, or other safety training events.
  • To share information among OSHA personnel and industry safety and health professionals regarding El Paso Community College good practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum) developed by the participants.

OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA's rulemaking and enforcement initiatives, training and education, and outreach and communication. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that party's products or services.

An implementation team made up of representatives of each organization will meet to develop a work plan, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least two times per year to track and share information on activities and results in achieving the goals of the Alliance. OSHA team members will include representatives of the El Paso Area Office and any other appropriate offices. OSHA will encourage State Plan States' and OSHA On-site Consultation Projects' participation on the team.

This agreement will remain in effect for two years. Either signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the written concurrence of both signatories.

ANNUAL ALLIANCE REPORT FOR SOUTH TEXAS EXPLORATION AND
PRODUCTION SAFETY NETWORK (STEPS)

  1. Alliance Background

    Date Signed.

    October 20, 2004 with the latest re-signing October 15, 2008. This alliance is to be renewed.

    Alliance Overview

    The STEPS alliance was formed to establish a collaborative relationship between the oil and gas onshore exploration and production industry and the OSHA Corpus Christi Area Office (CCAO) to improve the safety performance in South Texas. Through the years the alliance has expanded its focus beyond South Texas and has fostered the formation of similar networks in Oklahoma, West Texas, East Texas, Houston, South Louisiana, New Mexico, Wyoming, Colorado, and Illinois.

    Implementation team members included John Cantu, El Paso Production Company; Bobby Baber, BP North American Gas; Pat Marshall, South Texas Fuels; Ted Reed, BJ Services; Rick Ingram BP North American Gas; and Marianne McGee, OSHA Corpus Christi Area Office.

  3. Implementation Team Metings:

    January 20, 2010 - A meeting was held following the STEPS meeting to discuss the direction of the alliance and the areas requesting assistance in forming similar networks. STEPS Executive committee members Rick Ingram and Ted Reed agreed to speak at the kickoff meeting for the Illinois Basin STEPS Network scheduled for April 29, 2010.

    April 19, 2010 – A teleconference meeting was held with the Officers and Executive Committee Members. STEPS members John Beuhrig, ExxonMobil and Rick Ingram, BP America Production Company are assisting in the planning of the 2010 OSHA Oil and Gas Conference.

    July 21, 2010 – A meeting was held following the STEPS meeting with the Officers and Executive Committee Members to plan future meetings.

    October 20, 2010 – A meeting was held following the STEPS meeting with Officers and Executive Committee Members. All agreed to continue the alliance with OSHA. The Texas Department of Insurance is now interested in becoming a signatory to the alliance.

  4. Events and Products

    Alliance Activity.

    Training and Education: Monthly STEPS meetings are held the third Wednesday of the month from 8a.m. to noon. At each meeting there are three or four presenters on various safety and health topics which are relative to the industry. The topics are selected on their applicability to the industry and current events and safety performance. The STEPS alliance has been effective in delivering hazard recognition training to its members throughout the South Texas Network. Approximately three informational training sessions are conducted at each monthly South Texas STEPS Network meeting. Topics include industrial hygiene in the oil and gas industry, the new crane standard, fall protection requirements, safety and health program development, driving safety, the enforcement of the FRC usage, and much more. An average of 85 people attend each monthly meeting.

    An indirect product of the STEPS alliance has been the development by industry of the common orientation known as SafeLandUSA. The purpose of SafeLandUSA is to provide an effective 8 hour orientation to contract employees that will be recognized by the major producers. The benefit of this program will be a more consistent safety orientation from the producers and less time spent by the contract employees in orientation sessions that provide duplicate information.     Outreach and Communication: The South Texas STEPS Network members have assisted in developing STEPS Networks in Oklahoma, New Mexico, West Texas, East Texas, Fort Worth, Houston, Louisiana and Illinois. Several existing groups have chosen to become part of the National STEPS Network in an effort to coordinate communications throughout the industry. Existing networks that have combined with the National STEPS Network include The Western Slope Safety Council (Colorado) and Western Wyoming Community College.

    The South Texas STEPS membership has conducted extensive outreach to the oil and gas exploration and production industry. The STEPS members encourage their counterparts and competitors to attend the monthly STEPS meeting and expand their safety and health knowledge and to improve the safety performance of the industry.

    Promoting the National Dialogue on Safety and Health: The STEPS Network has been effective in creating a large network of individuals and groups in the oil and gas industry with the common goal of improving the safety performance. A National STEPS Network have been created to allow better communication through the networks and to assist in improving the lives of the workers.

    The 2010 OSHA Oil and Gas Conference was held in December 20108 in Dallas, Texas with nearly 1200 attendees. Three members of the South Texas STEPS Network were on the planning committee for this two day conference.

    A National STEPS Network website was developed by the South Texas group. The website currently lists the various STEPS networks and either a link to their website or contact information including their meeting dates, times, location and contact information.

    In July 2010 the OSHA National Office contacted the CCAO Compliance Assistance Specialist requesting participation of the STEPS Network in talks with the National Office and International Association of Drilling Contractors (IADC), Association of Energy Servicing Companies (AESC), and American Petroleum Institute (API) regarding fire retardant clothing (FRC) and the recent enforcement memorandum. Members of the South Texas STEPS, Permian Basis STEPS, and Mid Continent STEPS Networks traveled to Washington D. C. August 16, 2010 to participate in this meeting.

  5. Results

    A. The STEPS alliance has been integral in elevating safety in the exploration and production industry throughout the United States. As a result of the South Texas STEPS alliance at least 10 other networks have been formed to promote safety and health. An added benefit has been the improved communication between OSHA and the industry.
