    Overview

    Alliance between the United States Department of Labor’s Occupational Safety and Health Administration and T & T Staff Management, L.P. was established as a collaborative relationship to foster a safety and more healthful workplace for Americans working in the construction industries. The goal of the Alliance is to save lives, particularly in reducing and preventing exposure to construction hazards such as falls from elevations, struck-by and caught-in-between objects, and electrocution

    • May 6/7, 2004 Participated in the American Society of Safety Engineers (ASSE), First Annual “Safety without Borders” Safety Seminar held at the El Paso Convention Center. A booth was provided by T & T to promote the Alliance between OSHA and T & T.
    • July 14, 2004, T&T presented “An Alliance with OSHA” at the ASSE monthly meeting.
    • August 6, 2004, meeting at Vista Hills Country Club with over 200 employers where OSHA and T & T presented a duel program covering “Introduction to OSHA” and “ Upper Management’s Commitment to Safety”
    • August 11, 2004, T&T met with UTEP’s PACE to try and expand safety training in English and Spanish for the El Paso, West Texas, Southern New Mexico, and Northern New Mexico areas.
    • Since the inception of the Alliance in 2004, over 700 CFR Manuals published by Mangan Communications, Inc., have been issued by T & T to individuals in the construction industry in El Paso and surrounding areas.
    • Youth Outreach: In 2007 CFRs published by Mangan Communications, Inc., have been distributed to local school districts for distribution to students enrolled in Career and Technology course (i.e. Building Trades, Automotive Trades, etc.)
    Promoting the National Dialogue on Workplace Safety and Health
    • August 11, 2004, T&T met with UTEP’s PACE to try and expand safety training in English and Spanish for the El Paso, West Texas, Southern New Mexico, and Northern New Mexico areas.

DEPARTAMENTO DEL TRABAJO DE LOS ESTADOS UNIDOS DE AMÉRICA

EL CONSULADO GENERAL DE MÉXICO EN HOUSTON, TEXAS


Las Oficinas de área de Houston de la Administración de Seguridad y Salud Ocupacional (OSHA) del Departamento de Trabajo de los Estados Unidos de América y el Consulado de México en Houston, Texas (“el Consulado”), en adelante denominados conjuntamente “los Participantes”;

RECONOCIENDO el compromiso conjunto de proteger los derechos de los trabajadores mexicanos en los Estados Unidos, reconocidos en la Carta de Arreglo entre la Administración de Seguridad y Salud Ocupacional del Departamento del Trabajo de los Estados Unidos de América y la Secretaría de Relaciones Exteriores de los Estados Unidos Mexicanos, relativa a las Protecciones de Seguridad y Salud en el Lugar de Trabajo Aplicables a los Trabajadores Mexicanos en los Estados Unidos, firmada en Washington, D.C., el 6 de noviembre de 2014; y

RECONOCIENDO que el Programa de Alianza de la OSHA prevé el establecimiento de relaciones de cooperación para fines tales como la capacitación y la educación, difusión y comunicación, y para promover un diálogo nacional sobre la seguridad y la salud en el trabajo;

Se proponen establecer una Alianza para lograr lo siguiente:

Objetivo General

Los Participantes tienen la intención de establecer una relación de colaboración para proveer a los nacionales mexicanos y a otros en Houston, Texas información, orientación y acceso a recursos de capacitación y educación para promover los derechos de los trabajadores a la protección de su seguridad y salud ocupacionales, y para ayudarlos a entender la ley nacional de los Estados Unidos de América sobre los derechos de los trabajadores y las responsabilidades de los empleadores al amparo de la Ley de Seguridad y Salud Ocupacionales (OSH Act).

Capacitación y Educación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de capacitación y educación:

  • Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en Houston, Texas sobre la seguridad y la salud en el lugar de trabajo.
  • Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en Houston, Texas a fin de promover el entendimiento de los derechos de los trabajadores y las responsabilidades de los empleadores al amparo del OSH Act, incluyendo el uso del procedimiento de quejas de OSHA.

Difusión y Comunicación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de difusión y comunicación:

  • Elaborar información sobre el reconocimiento y la prevención de riesgos en el lugar de trabajo, y formular mecanismos para comunicar dicha información (por ejemplo, por medios impresos y electrónicos, herramientas de asistencia electrónica y enlaces al sitio Web de la OSHA desde el sitio Web del Consulado), a los nacionales mexicanos que trabajan en Houston, Texas y a sus empleadores.
  • Dar discursos, realizar exposiciones o presentarse en las conferencias, reuniones locales u otros eventos de los Participantes.
  • Participar en las actividades y los eventos del “Consulado Móvil”.

Promoción de un Diálogo Nacional

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos relacionados con la promoción de un diálogo conjunto sobre la seguridad y la salud en el lugar de trabajo:

  • Dar a conocer y demostrar el compromiso con la seguridad y la salud en el lugar de trabajo y los derechos de los trabajadores siempre que los funcionarios principales de los Participantes se dirijan al público.
  • Convocar o participar en foros, debates en mesas redondas o reuniones de interesados principales sobre cuestiones que afectan a los nacionales mexicanos que trabajan en Houston, Texas para ayudar a forjar soluciones innovadoras sobre cuestiones relativas a la seguridad y la salud en el lugar de trabajo, y el entendimiento los derechos de los trabajadores y las responsabilidades de los empleadores al amparo del OSH Act.

Un grupo de implementación, integrado por representantes de cada Participante, tiene la intención de reunirse para elaborar un plan de acción, determinar los procedimientos de trabajo y establecer las funciones y responsabilidades de los Participantes. Además, los Participantes tienen el propósito de reunirse por lo menos tres veces al año con fines de seguimiento e intercambio de información sobre las actividades y los resultados en torno al logro de los objetivos de la Alianza.

Nada de lo dispuesto en el presente Arreglo compromete a los Participantes a erogar recursos.

Este Arreglo puede iniciarse una vez firmado por los dos Participantes. El presente Arreglo puede durar dos (2) años a partir de la fecha de su firma. El Participante que tenga la intención de dar por terminado el presente Arreglo procurará notificar por escrito al respecto con treinta (30) días de antelación. El presente Arreglo podrá modificarse por escrito en cualquier momento mediante el consentimiento mutuo de los Participantes.

AGREEMENT RENEWING AN ALLIANCE
BETWEEN

The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) Baton Rouge Area Office and Associated Builders and Contractors, Inc. (ABC), Pelican Chapter continue to recognize the value of maintaining a collaborative relationship to foster safer and more healthful American workplaces. To that end, OSHA and ABC, Pelican Chapter hereby renew the Alliance signed May 3, 2012, and renewed on August 11, 2014, with a continued emphasis on information sharing and identification and elimination of workplace hazards. Specifically, both organizations are committed to providing ABC, Pelican Chapter members and others with information, guidance, and access to training resources that will help them protect the health and safety of workers and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act). Through the Alliance, the organizations will continue to address the reduction and prevention of exposures to struck-by, falls, caught-in-between and electrical hazards.

This renewal agreement provides a framework and objectives for the Alliance's activities. Alliance participants will summarize specific activities and timeframes for completion in a written work plan.

Through the Alliance the organizations will use relevant injury, illness, and hazard exposure data when appropriate to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options to evaluate the effectiveness of the Alliance and measure the impact of its overall effort on improving workplace safety for employers and workers, In renewing this Alliance, OSHA and ABC, Pelican Chapter recognize that OSHA's State Plan and On-Site Consultation Program partners are an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be share with these partners for the advancement of common goals.

Raising Awareness of OSHA's Rulemaking and Enforcement Initiatives

The Participants intend to work together to achieve the following objectives related to raising awareness of OSHA's rulemaking and enforcement initiatives:

  • To share information on OSHA's National/Regional/Local Emphasis Programs, Regulatory Agenda, and opportunities to participate in the rulemaking process.
  • To share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.
  • To convene or participate in forums, roundtable discussions, or stakeholder meetings on construction and industrial contractor safety and health issues to help forge innovative solutions in the workplace or to provide input on safety and health issues.
  • To encourage worker participation in workplace safety and health by organizing a forum aimed at worker outreach whereby ideas and information can be exchanged.

Training and Education

The Participants intend to work together to achieve the following training and education objectives:

  • To develop effective training and education programs for construction and industrial contractors regarding building and maintenance issues, and to communicate such information to constituent employers and workers.
  • To develop effective training and education programs for contractors to promote understanding of workers' rights, including the use of the OSHA complaint process, and the responsibilities of employers and to communicate such information to workers and employers.

Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication objectives:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and OSHA's and the ABC, Pelican Chapter Web sites) to employers and workers in the industry.
  • To speak, exhibit, or appear at OSHA's or ABC, Pelican Chapter conferences, local meetings, or other outreach events.
  • To share information among OSHA personnel and industry safety and health professionals regarding ABC, Pelican Chapter good practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum) developed by the participants.
  • To work with other Alliance participants on specific issues and projects on construction and industrial maintenance safety and health issues that are addressed and developed through the Alliance Program.

OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA's rulemaking and enforcement initiatives, training and education, and outreach and communication. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that party's products or services.

An implementation team made up of representatives of each organization will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance. OSHA team members will include representatives of the Baton Rouge Area Office and any other appropriate offices. OSHA will encourage State Plan States' and OSHA On-site Consultation Projects' participation on the team.

This agreement will remain in effect for five years. Either signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the written concurrence of both signatories.

      The Alliance between the United States Department of Labor's Occupational Safety and Health Administration and T&T Staff Management, Inc. was established as a collaborative relationship to foster a safety and more healthful workplace for Americans working in the construction industries. The goal of the Alliance is to save lives, particularly in reducing and preventing exposure to construction hazards such as falls from elevations, struck-by and caught-in-between objects, and electrocution.

    Alliance Activity

    • Training and Education: OSHA has provided WDP with 200 copies of OSHA publications for distribution in their construction safety orientation classes.
    • Outreach and Communication: OSHA participated in 11 monthly WDP in-take nights to provide Hispanic workers the opportunity to ask questions and file complaints with OSHA. WDP conducts intake nights to allow workers to make complaints about workplace safety issues and nonpayment of wages complaints. As a result of the intake nights, OSHA has received six worker complaints that were taken in person at intake nights, four complaints were emailed to the AAO CAS, one whistleblower complaint, and one complaint that was referred to MSHA. OSHA fielded numerous safety and health questions from workers and WDP staff and volunteers.
    • Promoting the National Dialogue on Safety and Health: OSHA and WDP have worked to promote knowledge about worker rights in Central Texas through a wide range of events targeted to reach immigrant Spanish-speaking workers. WDP has made ten referrals on unsafe worksite conditions, most of which resulted in OSHA inspections that have protected workers from fall hazards in construction, amputations, and eye injuries due to PPE. These referrals were a direct result of the closer working relationship between OSHA and WDP.

    Alliance Products

    • Training and Education: OSHA has provided approximately 200 pamphlets for WDP construction safety orientations, and intake nights in the past year. WDP has developed an OSHA 10-hour and safety orientation training that covers fall protection and focus four hazards. OSHA has publicized these events to assist WDP in finding Spanish-speaking attendees. Both WDP and OSHA participated in Labor Rights Week to do outreach to Spanish speaking workers at events across Austin.
    • Outreach and Communication: WDP communicates with OSHA staff frequently to make referrals, make general safety & health inquiries, and to file complaints on behalf of Hispanic workers. OSHA has also received complaints during the intake nights. OSHA has put WDP in contact with free outreach events that WDP may wish to participate in. WDP and OSHA have worked with the Mexican Consulate to do joint network and conduct joint activities to reach out to immigrant workers, particularly on events such as Workers Memorial Day, and Labor Rights Week.
    • Promoting the National Dialogue on Safety and Health: The alliance has opened the door of communication with immigrant Spanish workers in the Austin and nationally, so that they can exercise their right to a safe and healthy workplace.

    The alliance has raised the Agency’s profile with hard to reach immigrant Spanish-speaking workers in the Austin area through a multi-pronged approach.

  5. Upcoming Milestones

    The alliance has impacted Hispanic construction workers by offering low cost or free OSHA 10 hour classes, fall protection, and focus four-hazard training and through the development of targeted training materials in Spanish offered by WDP. The alliance provides a conduit for Hispanic workers to exercise their OSHA workplace rights. The OSHA CAS has been the main contact for questions from WDP staff. The alliance was renewed on August 28, 2018 for another 3 years.

      The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) Oklahoma City, OK Area Office (hereafter referred to as OSHA) and The Oklahoma Local Section of The American Industrial Hygiene Association (hereafter referred to as OKAIHA) continue to recognize the value of maintaining a collaborative relationship to foster safer and more healthful American workplaces. To that end, OSHA and OKAIHA hereby renew the Alliance signed August 21, 2012 and renewed August 21, 2014, with a continued emphasis on safety and health training. Specifically, both organization(s) are committed to providing OKAIHA members and others with information, guidance, and access to training resources that will help them protect the health and safety of workers and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act). Through the Alliance, the organizations will continue to address occupational safety and health issues. This renewal agreement provides a framework and objectives for the Alliance's activities.     This alliance has resulted in a very close relationship and cooperation between OSHA and members of OKAIHA which encompass representatives of academia, industry and other federal agencies.

    The Conferences on the "Regulatory Update" have provided valuable information to attendees regarding the various aspects of OSHA activities and emerging issues as well as Environmental Compliance and Workers Compensation.

    The Spring Conference and dinner and lunch meetings with guest speakers provided education and outreach on Industrial Hygiene exposure estimating, youth safety programs and the OSHA VPP program.

      The Greater Baton Rouge Chapter of the American Society of Safety Engineers (ASSE) is a non-profit organization that was founded in September 1957. The current membership is comprised of over 300 safety professionals who represent employers from various industries such as construction, refinery, chemical, heath care, insurance, and governmental agencies.

      The Occupational Safety and Health Administration (OSHA), Baton Rouge Area Office and Greater Baton Rouge Chapter, ASSE set out to form an Alliance in order to provide Chapter members and others with information, guidance, and access to training resources that will help foster employee health and safety, particularly in reducing and preventing exposure including, but not limited to: fall hazards, trenching/excavations, combustible dusts, and struck-by hazards.

  2. Implementation Team Meetings

    The implementation team holds meetings to discuss the objectives and progress toward the goals set forth within the signed Alliance document. The discussions occur by face-to-face meetings and e-mail communications. The implementation team also addresses attendees of the monthly general membership meetings that are held at various locations in Baton Rouge.

    Training and Education

    • The Chapter Board members participate in the annual Louisiana Governor’s Safety and Health Conference to promote membership, safety education, and safety certification.
    • The Chapter Board members also participate in several other safety-training workshops and serve in various capacities within the safety communities at the local, state, and national levels, including various industries.

     

    Outreach and Communication

    • Regular compliance updates are provided by representatives from the OSHA, Baton Rouge Area Office that includes occasional appearances at monthly membership meetings to discuss the latest regulatory information.
    • The OSHA, Baton Rouge Area Office, CAS provides daily e-mail updates to officers and executive committee members on current events related to occupational safety and health. The information provided is further distributed throughout industry.
    • The Chapter holds monthly general meetings that include guest speakers who discuss topics related to Health, Safety or Environmental issues and/or current events.
    • The Chapter will continue to host the “Bring-a-Worker” meetings where members invite their employees to attend, in addition to other outreach efforts.

     

    Promoting the National Dialogue on Workplace Safety and Health

    • Members of the Greater Baton Rouge Chapter, ASSE Executive Board and General Membership continued to foster relationships and share ideas through their involvement with other professional association safety committees which include: Associated Builders and Contractors, Pelican Chapter; Safety Council of Louisiana; Greater Baton Rouge Industry Alliance; ANSI/ASSE Z-59 Fall Protection Standard Advisory Committee; Southeastern Louisiana University, Occupational Safety & Health Curriculum Advisory Steering Committee; Associated General Contractors, South Louisiana STEPS Network, and the National Petroleum & Refining Association National Safety Committee.
    • Joint membership meetings were also held with the American Industrial Hygiene Association.
    • The OSHA, Baton Rouge Area Office, CAS provided an OSHA Update presentation, question and answer session for a Chapter meeting.
    • The Chapter annually recognizes Workers’ Memorial Day as a day of remembrance for fallen workers and communicates related information to members and others in the industry.
    • The Chapter recognizes and communicates information relating to national initiatives such as, the National Safety Stand-Down to Prevent Fatalities in Construction.

    The Chapter members continue to have access to a greater amount of educational information and are made aware of OSHA’s on-going efforts to reach at-risk industries by sharing current events, safety alerts and best practices.

  3. Activities, Events and Products

    Alliance Activity

    • Training and Education: OSHA has assisted the Consulate in finding low cost and free OSHA 10 hour construction safety classes offered by the Texas Department of Insurance and the Workers Defense Project. A training session was also provided to Consulate staff on OSHA complaint intake during Labor Rights Week.
    • Outreach and Communication: OSHA participated in exhibit table events at the Mexican Consulate to distribute worker's rights information to Mexican Nationals visiting the Consulate. OSHA, the Mexican Consulate, and another alliance partner, the Workers Defense Project, have joined together to assist Mexican workers needing assistance with unsafe jobsite conditions, and injured workers whose employers refuse to pay for their medical bills. One of the main outreach events planned with the Consulate is Labor Rights Week. The Consulate also participated in the Worker Memorial Day event planned and hosted by the Worker's Defense Project in April 2016.
    • Promoting the National Dialogue on Safety and Health: OSHA added the Consulate contacts to her email distribution lists on free and low cost safety classes, and other local safety events.

     

    Alliance Products

    • Training and Education: OSHA has provided approximately 500 pamphlets for Labor Rights Week distribution bags that were handed out at seven events during Labor Rights Week. The Consulate also retained 500 All About OSHA pamphlets for distribution at the Consulate. Approximately 600 Hispanic workers were reached through exhibit tables at the Consulate.
    • Outreach and Communication: Labor Rights Week events were spearheaded by the Consulate. Participants included governmental and nonprofit organizations, with four additional groups participating this year over last year's events. There were a total number of eight events in 2016, versus four that took place in 2015. The groups participating in Labor Rights Week included Wage & Hour, Texas Rio Grande Legal Aid, Catholic Charities, Equal Justice Center, Austin Police Department, Refugee Services of Texas, and EEOC, in addition to the Consulate and OSHA. A total of 500 bags of information were distributed at events across Austin, containing information on labor rights, legal rights, and human trafficking. The events during Labor Rights Week included distribution of informational bags at two La Michocana markets on two evenings to contact workers after work, distribution of info bags at the day labor center and at a construction worker parking area in the mornings, and distribution of bags at the Consulate. As part of Labor Rights Week, a phone bank on worker rights was held at local Spanish TV station Univision in Austin to do intake on various worker's rights issues such as wage theft and discrimination. OSHA, EEOC, and Wage & Hour also provided training to all the groups participating in Labor Rights Week on the information needed to make a referral to OSHA, EEOC, or Wage & Hour.
    • Promoting the National Dialogue on Safety and Health: The alliance has opened the door of communication with immigrant Spanish workers in the Austin and nationally, so that they can exercise their right to a safe and healthy workplace.
  4. Results

    The alliance has raised the Agency’s profile with hard to reach immigrant Spanish speaking workers in the Austin area through a multi-pronged approach.

  5. Upcoming Milestones

    The alliance provides a conduit for Hispanic workers to exercise their OSHA workplace rights. The OSHA CAS has been the main contact for questions from Consular staff. The alliance was last renewed on August 31, 2015 for another 2 years.

    Alliance Overview

    The Greater Baton Rouge Chapter of the American Society of Safety Engineers (ASSE) is a non-profit organization that was founded in September 1957. The current membership is comprised of over 300 safety professionals who represent employers from various industries such as construction, refinery, chemical, and governmental agencies.

    OSHA and Greater Baton Rouge Chapter ASSE set out to form an Alliance in order to provide Chapter members and others with information, guidance, and access to training resources that will help foster employee health and safety, particularly in reducing and preventing exposure including, but not limited to: fall hazards, trenching/excavations, combustible dusts, and struck-by hazards.

    The implementation team met three (3) times during the evaluation period to discuss the objectives and progress toward the goals set forth within the signed Alliance document. The implementation team also addressed attendees of the monthly general membership meetings that were held at various restaurants in the Greater Baton Rouge Area.

      The Chapter hosted an ASP/CSP certification workshop to benefit members as well as the general public.

      Continuous updates from local OSHA office including occasional appearances at monthly membership meetings to discuss latest regulatory impacts as applicable.

      The chapter holds monthly General Meetings include Guest Speakers who discussed topics concerning Health, Safety or Environmental issues and/or current events.

      The chapter officers and local OSHA representatives produce informative Emails, newsletters, and Safety Alerts that are distributed to Chapter Membership, Guests and Professional Colleagues.

      The Chapter continues to participate in the Adopt-a-School program where volunteers visit local high schools to discuss and promote workplace safety. In addition, PPE is donated to schools from the members of the general membership.

    Promoting the National Dialogue on Workplace Safety and Health

    1. Events

      Members of the Greater Baton Rouge Chapter ASSE Executive Board and General Membership continue to foster relationships and shared ideas through their involvement with other Professional Association Safety Committees including but not limited to: Associated Builders and Contractors Pelican Chapter, Safety Council of Louisiana, Greater Baton Rouge Industry Alliance, ANSI/ASSE Z-59 Fall Protection Standard Advisory Committee, Southeastern Louisiana University’s Occupational Safety & Health Curriculum Advisory Steering Committee, and the National Petroleum & Refining Association National Safety Committee.

      Joint Membership meetings were also held with the American Industrial Hygiene Association and the Bayou Chapter ASSE.

  5. Results

    The Greater Baton Rouge Chapter ASSE Members now have access to a greater of amount of educational information and have been exposed the continued efforts of OSHA to reach at-risk industries by sharing current events, safety alerts and best practices.

    OSHA Update

    As with the previous year, the OSHA-BRAO Compliance Assistance Specialist (CAS) provided OSHA Update presentations and gave presentations at various member workplaces. At each month’s meeting, the CAS provided literature which included educational brochures, pamphlets and training materials. Topics provided but were not limited to: Concrete and Masonry Construction, Work Zone Safety Fact Sheets, Process Safety Management, and Scaffolding Safety.

  6. Upcoming Milestones

    The Baton Rouge area OSHA and the Greater Baton Rouge Chapter ASSE will continue to work together through the Alliance to provide employers, employees, OSHA staff and the public with information targeted at the individual worker. Specifically, the chapter will host a membership meeting where individual workers will be invited. The meeting topic will be on worker rights to a safe workplace.

    In addition, the Regional ASSE Professional Development Conference (PDC) is returning to New Orleans in the first quarter of 2012. The ASSE Baton Rouge chapter, the area office compliance assistance staff and area director will conduct presentations and provide conference participants with OSHA publications and relevant topics.

The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) Austin Area Office and Workers Defense Project continue to recognize the value of maintaining a collaborative relationship to foster safer and more healthful American workplaces. To that end, OSHA and Workers Defense Project hereby renew the Alliance signed July 15, 2010 and renewed on August 23, 2012 and August 22, 2014, with a continued emphasis on Hispanic construction worker safety. Specifically, both organization(s) are committed to providing Workers Defense Project members and others with information, guidance, and access to training resources that will help them protect the health and safety of workers and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act). Through the Alliance, the organizations will continue to address immigrant worker safety in construction.

This renewal agreement provides a framework and objectives for the Alliance's activities. Alliance participants will summarize specific activities and timeframes for completion in a written work plan.

Through the Alliance, the organizations will use relevant injury, illness, and hazard exposure data when appropriate to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options to evaluate the effectiveness of the Alliance and measure the impact of its overall effort on improving workplace safety for employers and workers. In renewing this Alliance, OSHA and Workers Defense Project recognize that OSHA's State Plan and On-site Consultation Project partners are an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be shared with these partners for the advancement of common goals.

Raising Awareness of OSHA's Rulemaking and Enforcement Initiatives

The Participants intend to work together to achieve the following objectives related to raising awareness of OSHA's rulemaking and enforcement initiatives:

  • To share information on OSHA's National/Regional/Local Emphasis Programs, Regulatory Agenda, and opportunities to participate in the rulemaking process.
  • To share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.
  • To convene or participate in forums, roundtable discussions, or stakeholder meetings on construction worker safety to help forge innovative solutions in the workplace or to provide input on safety and health issues.
  • To encourage worker participation in workplace safety and health by providing informational materials and training sessions on OSHA construction initiatives.

Training and Education

The Participants intend to work together to achieve the following training and education objectives:

  • To develop effective training and education programs for construction workers regarding the focus four hazards, and to communicate such information to constituent employers and workers.
  • To develop effective training and education programs for construction workers to promote understanding of workers' rights, including the use of the OSHA complaint process, and the responsibilities of employers and to communicate such information to workers and employers.

Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication objectives:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and OSHA's and the Workers Defense Project Web sites) to employers and workers in the industry.
  • To speak, exhibit, or appear at OSHA's or Workers Defense Project conferences, local meetings, or other events.
  • To share information among OSHA personnel and industry safety and health professionals regarding Workers Defense Project's good practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum) developed by the participants.
  • To work with other Alliance participants on specific issues and projects on construction worker safety that are addressed and developed through the Alliance Program.

OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA's rulemaking and enforcement initiatives, training and education, and outreach and communication. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that party's products or services.

An implementation team made up of representatives of each organization will meet to develop a work plan, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least two times per year to track and share information on activities and results in achieving the goals of the Alliance. OSHA team members will include representatives of the Austin area office and any other appropriate offices. OSHA will encourage State Plan States' and OSHA On-site Consultation Projects' participation on the team.

This agreement will remain in effect for 2 years. Either signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the written concurrence of both signatories.
