EL CONSULADO DE MÉXICO EN ORLANDO, FLORIDA


La Oficina de Área de Tampa de la Administración de Seguridad y Salud Ocupacional (OSHA) del Departamento de Trabajo de los Estados Unidos de América y el Consulado de México en Orlando, Florida, en adelante denominados conjuntamente "los Participantes";

RECONOCIENDO el compromiso conjunto de proteger los derechos de los trabajadores mexicanos en los Estados Unidos, reconocidos en la Carta de Arreglo entre la Administración de Seguridad y Salud Ocupacional del Departamento del Trabajo de los Estados Unidos de América y la Secretaría de Relaciones Exteriores de los Estados Unidos Mexicanos, firmada en Washington, D.C., el 6 de noviembre de 2014; y

RECONOCIENDO que el Programa de Alianza de la OSHA prevé el establecimiento de relaciones de cooperación para fines tales como la capacitación y la educación, difusión y comunicación, y para promover un diálogo nacional sobre la seguridad y la salud en el trabajo;

Se proponen establecer una Alianza para lograr lo siguiente:

Objetivo general

Los Participantes tienen la intención de establecer una relación de colaboración para proveer a los nacionales mexicanos y a otros en el centro y norte de Florida información, orientación y acceso a recursos de capacitación y educación para promover los derechos de los trabajadores a la protección de su seguridad y salud ocupacionales, y para ayudarlos a entender la ley nacional de los Estados Unidos de América sobre los derechos de los trabajadores y las responsabilidades de los empleadores al amparo de la Ley de Seguridad y Salud Ocupacionales (OSH Act).

Capacitación y educación

Los Participantes desean establecer una relación de colaboración con el fin de alcanzar las siguientes metas de capacitación y educación:

  • Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en el centro y norte de Florida sobre la seguridad y la salud en el lugar de trabajo.
  • Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en el centro y norte de Florida a fin de promover el entendimiento de los derechos de los trabajadores y las responsabilidades de los empleadores al amparo del OSH Act, incluyendo el uso del procedimiento de quejas de OSHA.

Difusión y Comunicación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de difusión y comunicación:

  • Elaborar información sobre el reconocimiento y la prevención de riesgos en el lugar de trabajo, y formular mecanismos para comunicar dicha información (por ejemplo, por medios impresos y electrónicos, herramientas de asistencia electrónica y enlaces al sitio Web de la OSHA desde el sitio Web del Consulado), a los nacionales mexicanos que trabajan en el centro y norte de Florida y a sus empleadores.
  • Dar discursos, realizar exposiciones o presentarse en las conferencias, reuniones locales u otros eventos de los Participantes.
  • Participar en las actividades y los eventos del "Consulado Móvil".

Promoción de un diálogo nacional

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos relacionados con la promoción de un diálogo conjunto sobre la seguridad y la salud en el lugar de trabajo:

  • Dar a conocer y demostrar el compromiso con la seguridad y la salud en el lugar de trabajo y los derechos de los trabajadores siempre que los funcionarios principales de los Participantes se dirijan al público.
  • Convocar o participar en foros, debates en mesas redondas o reuniones de interesados principales sobre cuestiones que afectan a los nacionales mexicanos que trabajan en el centro y norte de Florida para ayudar a forjar soluciones innovadoras sobre cuestiones relativas a la seguridad y la salud en el lugar de trabajo, y el entendimiento los derechos de los trabajadores y las responsabilidades de los empleadores al amparo del OSH Act.

Un grupo de implementación, integrado por representantes de cada Participante, tiene la intención de reunirse para elaborar un plan de acción, determinar los procedimientos de trabajo y establecer las funciones y responsabilidades de los Participantes. Además, los Participantes tienen el propósito de reunirse por lo menos tres veces al año con fines de seguimiento e intercambio de información sobre las actividades y los resultados en torno al logro de los objetivos de la Alianza.

Nada de lo dispuesto en el presente Arreglo compromete a los Participantes a erogar recursos.

Este Arreglo puede iniciarse una vez firmado por los dos Participantes. El presente Arreglo puede durar dos (2) años a partir de la fecha de su firma. El Participante que tenga la intención de dar por terminado el presente Arreglo procurará notificar por escrito al respecto con treinta (30) días de antelación. El presente Arreglo podrá modificarse por escrito en cualquier momento mediante el consentimiento mutuo de los Participantes.

    • To develop effective training and education programs for workers in the electrical utility industry regarding hazard recognition, safety and health management systems (SHMS) and health hazards, and to communicate such information to constituent employers and workers.
    • • To deliver or arrange for the delivery of courses regarding fatal accidents in the electrical utility industry, including improper Personal Protective Equipment (PPE), failure to maintain a safe distance, and failure to utilize proper equipotential grounding techniques. The Alliance participants will ensure that experienced workers, as well as, inexperienced workers, including, but not limited to apprentices lineman will receive training.

To that end, OSHA and the ABC - North AL Chapter Alliance hereby form an Alliance to provide ABC - North AL Chapter members and others with information, guidance, and access to training resources that will help them protect the health and safety of workers, particularly by reducing and preventing exposure to hazards associated in the construction industry, such as but not limited to falls, electrocution, struck-by and caught-in-between hazards, and to help them understand the rights and responsibilities of employers and workers under the Occupational Safety and Health Act (OSH Act). Emphasis will be placed on effectively communicating adequate protection regarding these types of hazards to the hard-to-reach groups, such as small businesses. In developing this agreement, the ABC - North AL Chapter Alliance participants recognize that OSHA's State Plan and On-site Consultation Project partners are an integral part of the OSHA national effort.

Raising Awareness of OSHA's Rulemaking and Enforcement Initiatives

The Participants intend to work together to achieve the following goals related to raising awareness of OSHA's rulemaking and enforcement initiatives:

  • To share information on OSHA's National/Regional/Local Emphasis Programs, Regulatory Agenda, and opportunities to participate in the rulemaking process.
  • To share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.
  • To encourage worker participation in workplace safety and health by sharing information on best practices as agreed upon by OSHA and the ABC - North AL Chapter. 

Training and Education

The Participants will work together to achieve the following training and education goal:

  • To develop effective training and education programs for ABC - North AL Chapter members and others regarding the prevention of fall, electrocution, struck-by and caught-in-between related hazards, and to communicate such information to constituent employers and workers.
  • To deliver or arrange for the delivery of safety and health training focused on the prevention of fall, electrocution, struck-by and caught-in-between related hazards.

Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication goals:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and OSHA's and the ABC - North AL Chapter's Web sites) to employers and workers in the industry.
  • To speak, exhibit, or appear at OSHA's or ABC - North AL Chapter's conferences, local meetings, or other events, such as the quarterly safety summit meetings held by the ABC - North AL Chapter.
  • To share information among OSHA personnel and industry safety and health professionals regarding the ABC - North AL Chapter good practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum) developed by the participants.
  • Promote and encourage ABC - North AL Chapter members participation in cooperative programs such as compliance assistance and VPP; and

OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as training and education, outreach and communication and promoting a national dialogue on workplace safety and health.  These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing any of that party's products or services; nor does the Agency enter into an Alliance with the purpose of promoting a particular party's products or services.

An implementation team made up of representatives of each participating organization will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the Participants.  In addition, they will meet at least three times per year to track and to share information on activities and results in achieving the goals of the Alliance. OSHA team members will include representatives of the Birmingham Area Office. OSHA will encourage State Plan States' and OSHA On-site Consultation Projects' participation on the team.
This agreement will remain in effect for two years from the date of signing. Any signatory may terminate it for any reason at any time, provided they give 30 days written notice to the other participants. This agreement may be modified at any time with the written concurrence of all signatories.

Overview:

The Occupational Safety and Health Administration (OSHA), the Southeastern Line Constructors Chapter of the National Electrical Contractors Association (SLCC/NECA), the International Brotherhood of Electrical Workers (IBEW) 5th and tenth districts, and the Southeastern Line Constructors Apprenticeship and Training (SELCAT) work cooperatively to provide workers and others with information, guidance, and access to training resources that will help them protect employees’ health and safety, particularly in reducing and preventing exposure to electrical transmission and distribution equipment hazards.

II. Implementation Team Membership and Contributors:

Representatives from OSHA, SLCC/NECA, IBEW, and SELCAT conducted effective meetings on the following dates: April 26, 2011; August 17, 2011; November 9, 2011; and March 14, 2012.

Events

  • On September 6, 2011, from 7 to 8 a.m. the Alliance group successfully coordinated an “Electrical Safety Stand-Down” for electrical transmission and distribution industry employers and employees in Alabama, Florida, Georgia and Tennessee. At the start of that day’s work shift, employers were asked to use that first hour to provide training to their electrical work crews on the prevention of storm work-related hazards. Sponsors for this event included OSHA, SLCC/NECA, IBEW and SELCAT. Event participants are listed below:
    • IBEW Fifth and Tenth Districts
    • 2 Contractors
  • During the November 9, 2011, Alliance meeting the group began planning its third “Electrical Safety Stand-Down” for electrical transmission and distribution industry employers and employees in Alabama, Florida, Georgia and Tennessee. The event took place on February 6, 2012, and it was focused on the prevention of struck by accidents.
  • SELCAT continued its efforts to provide workers with effective training and education programs focusing on electrical utility industry issues, as well as safety and health. Course topics included the following:
    • OSHA 10-hour training course
    • First-Aid and cardiopulmonary resuscitation(CPR)
    • Pole Top and Bucket Truck Rescue
    • Transformer Safety Courses 1 & 2

Events

  • The Alliance agreement was formally renewed on July 1, 2011.
  • The Alliance was promoted during the NECA Safety Professional Conference on May 22 – 24, 2011, in Dallas, TX.
  • During this period, the Alliance group continued to offer employees and member companies the opportunity to share their near-miss information with other participants through the NECA Chapter Web site.
  • On March 14, 2012, Mr. Jerry Rivera, NECA Director of Safety, conducted a safety and health presentation for the group. Mr. Rivera’s presentation addressed a wide range of topics including the following: fall protection; OSHA’s regulatory agenda; and industry best practices.

  • During this period, the group continued to publish and distribute the Safety Alliance Update Quarterly Newsletter, which reaches over 1,600 employees and companies.

The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) Jacksonville Area Office and the Safety Alliance – Jacksonville Chapter (SAFE) (henceforth "OSHA and SAFE" or the "Participants") recognize the value of establishing a collaborative relationship to foster safety and health practices and programs to improve American workplaces. To that end, OSHA and SAFE hereby form an Alliance to provide SAFE members and the public with information, guidance, and access to training resources that will help them protect workers by reducing and preventing exposure to general industry hazards, as well as construction industry hazards. Emphasis will be placed on preventing hazardous exposure related to the four leading causes of fatalities in the construction industry: falls, electrical, struck-by and caught-in-between hazards. Effort will also be made to ensure that SAFE members and others understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

This agreement provides a framework and objectives for the Alliance's activities. Alliance participants can summarize specific activities and timeframes for completion in a written work plan.

Through the Alliance, the organizations will use available injury, illness, and hazard exposure data, when appropriate, to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options, including but not limited to member surveys, to evaluate the effectiveness of the Alliance and measure the impact of its overall effort on improving workplace safety and health. In developing this Alliance, OSHA and SAFE recognize that OSHA's State Plan and On-site Consultation Program partners are an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be shared with these partners for the advancement of common goals.

Raising Awareness: Outreach and Communication

The Participants intend to work together to achieve the following objectives:

  • Share information on OSHA's National/Regional/Local Emphasis Programs, Regulatory Agenda, and opportunities to participate in the rulemaking process.
  • Share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.
  • Develop information on the recognition and prevention of workplace hazards, and develop ways of communicating such information (e.g., via print and electronic media, electronic assistance tools, and the OSHA and SAFE websites) to employers and workers in the construction industry.
  • Speak, exhibit, or appear at OSHA or SAFE conferences, local meetings, or other co-sponsored events.
  • Convene or participate in forums, roundtable discussions, stakeholder meetings, or other activities, which highlight the local fatality data. The goal of this effort is to reduce fall, electrical, struck-by and caught-in-between hazards and to help forge innovative solutions in the workplace.
  • Share information among OSHA personnel and industry safety and health professionals regarding SAFE's good practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum) developed by the Participants.
  • Encourage worker participation in workplace safety and health by collaborating and mentoring trade contractors, as well as general industry representatives.
  • Collaborate with other Alliance Program participants on specific issues and projects related to the construction industry that are addressed and developed through the Alliance Program.

Training and Education

The Participants intend to work together to achieve the following objectives:

  • Develop effective training and education programs for construction, general, maritime, and agriculture industries regarding fall protection, electrical hazards, struck-by and caught-in-between hazards, and communicate such information to constituent employers and workers.
  • Develop effective training and education programs for general industry to promote understanding of workers' rights, including the use of the OSHA complaint process, and the responsibilities of employers, and to communicate such information to workers and employers.
  • Deliver or arrange for the delivery of fall protection, electrical hazards, struck-by and caught-in-between hazards courses.

OSHA's Alliance Program provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA's initiatives, outreach, communications, training, and education. These Alliances have proven to be valuable tools for both OSHA and its Alliance Program participants. By entering into an Alliance with a party, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that party's products or services.

An implementation team made up of representatives of each organization will meet one to two times per year to track and share information on activities and results in achieving the goals of the Alliance. OSHA team members will include representatives of the Jacksonville Area Office and any other appropriate offices. OSHA will encourage OSHA On-site Consultation programs' participation on the team.

Overview

OSHA and Alabama Trucking Association Workers Compensation formed an Alliance to provide ATAWCF members and others with information, guidance, and access to training resources that will help them protect employees’ health and safety, particularly in reducing and preventing exposure to hazards on the highway, at pick-up and delivery points, at maintenance shops, and administrative business locations.

  • OSHA Fact Sheet regarding “Whistleblower Protection for Truck Drivers” was distributed to the ATAWCF.

AGREEMENT ESTABLISHING AN ALLIANCE
BETWEEN
FORT LAUDERDALE AREA OFFICE
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION
U.S. DEPARTMENT OF LABOR
AND
SAFETY ALLIANCE FOR EXCELLENCE (SAFE)


The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) Fort Lauderdale Area Office and the Safety Alliance for Excellence (SAFE) (henceforth “OSHA and SAFE” or the “Participants”) recognize the value of establishing a collaborative relationship to foster safer and more healthful American workplaces. To that end, OSHA and SAFE hereby form an Alliance to provide SAFE members and others with information, guidance, and access to training resources that will help them protect the health and safety of workers, by reducing and preventing exposures in the construction industry related to the four leading causes of fatalities; Falls, Electrical, Struck-By and Caught-In-Between and understanding the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act). In developing this Alliance, OSHA and SAFE recognize that OSHA's On-site Consultation partner, the University of South Florida, are an integral part of the OSHA national effort.

Raising Awareness of OSHA's Rulemaking and Enforcement Initiatives

The Participants intend to work together to achieve the following goals related to raising awareness of OSHA's rulemaking and enforcement initiatives:

  • To share information on OSHA's National/Regional/Local Emphasis Programs, Regulatory Agenda, and opportunities to participate in the rulemaking process.
  • To share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.
  • To convene or participate in forums, roundtable discussions, or stakeholder meetings on fall protection, electrical hazards, struck-by and caught-in-between hazards to help forge innovative solutions in the workplace or to provide input on safety and health issues.
  • To encourage worker participation in workplace safety and health by partnering and mentoring trade contractors.

Training and Education

The Participants intend to work together to achieve the following training and education goals:

  • To develop effective training and education programs for the construction industry regarding fall protection, electrical hazards, struck-by and caught-in-between hazards and to communicate such information to constituent employers and workers.
  • To develop effective training and education programs for the construction industry to promote understanding of workers' rights, including the use of the OSHA complaint process, and the responsibilities of employers and to communicate such information to workers and employers.
  • To deliver or arrange for the delivery of fall protection, electrical hazards, struck-by and caught-in-between hazards courses.

Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication goals:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and OSHA's and SAFE's Web sites) to employers and workers in the construction industry.
  • To speak, exhibit, or appear at OSHA's or SAFE's conferences, local meetings, or other co-sponsored events.
  • To share information among OSHA personnel and industry safety and health professionals regarding SAFE's good practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum) developed by the Participants.
  • To work with other Alliance participants on specific issues and projects related to the construction industry that are addressed and developed through the Alliance Program.

OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA's rulemaking and enforcement initiatives, training and education, and outreach and communication. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that party's products or services.

An implementation team made up of representatives of each organization will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance. OSHA team members will include representatives of the Fort Lauderdale Area Office and any other appropriate offices. OSHA will encourage OSHA On-site Consultation Projects' participation on the team.

This agreement will remain in effect for two years. Either signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the written concurrence of both signatories.
