RECONOCIENDO el compromiso conjunto de proteger los derechos de los trabajadores mexicanos en los Estados Unidos reconocidos en la Carta de Arreglo entre la Secretaría de Relaciones Exteriores de los Estados Unidos Mexicanos y la Administración de Seguridad y Salud Ocupacional del Departamento de Trabajo de los Estados Unidos de América relativa a las Protecciones de Seguridad y Salud en el Lugar de Trabajo Aplicables a los Trabajadores Mexicanos en los Estados Unidos, firmada en Washington, D.C., el 2 de septiembre de 2021; y
RECONOCIENDO que el Programa de Alianza de la OSHA prevé el establecimiento de relaciones de cooperación para fines tales como la capacitación y la educación, difusión y comunicación, y para promover un diálogo nacional sobre la seguridad y la salud en el trabajo;
Se proponen establecer una Alianza para lograr lo siguiente:
Los Participantes tienen la intención de establecer una relación de colaboración para proveer a los nacionales mexicanos y a otros en Pensilvania y Delaware información, orientación y acceso a recursos de capacitación y educación para promover los derechos de los trabajadores a la protección de su seguridad y salud ocupacionales, y para ayudarlos a entender la ley nacional de los Estados Unidos de América sobre los derechos de los trabajadores y las responsabilidades de los empleadores al amparo de la Ley de Seguridad y Salud Ocupacional (OSH Act).
Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de capacitación y educación:

Un grupo de implementación, integrado por representantes de cada Participante, tiene la intención de reunirse para elaborar un plan de acción, determinar los procedimientos de trabajo y establecer las funciones y responsabilidades de los Participantes. Además, los Participantes tienen el propósito de reunirse por lo menos tres veces al año con fines de seguimiento e intercambio de información sobre las actividades y los resultados en torno al logro de los objetivos de la Alianza.
Nada de lo dispuesto en el presente Arreglo compromete a los Participantes a erogar recursos.
Este Arreglo puede iniciarse una vez firmado por los dos Participantes. El presente Arreglo puede durar dos (2) años a partir de la fecha de su firma. El Participante que tenga la intención de dar por terminado el presente Arreglo procurará notificar por escrito al respecto con treinta (30) días de antelación. El presente Arreglo podrá modificarse por escrito en cualquier momento mediante el consentimiento mutuo de los Participantes.

RECOGNIZING the joint commitment to protect workers' rights for Mexican workers in the United States acknowledged in the Letter of Arrangement between the Occupational Safety and Health Administration of the Department of Labor of the United States of America and the Ministry of Foreign Affairs of the United Mexican States, concerning Workplace Safety and Health Protections Applicable to Mexican Workers in the United States, signed Washington, D.C., on September 2, 2021;
RECOGNIZING that OSHA's Alliance Program provides for the establishment of cooperative relationships for purposes such as training and education, outreach and communication, and promoting a national dialogue on workplace safety and health;
Intend to form an Alliance to achieve the following:
The Participants intend to establish a collaborative relationship to provide Mexican Nationals in Pennsylvania and Delaware and others information, guidance, and access to education and training resources to promote workers' rights in protecting their occupational safety and health, and to help them understand U.S. domestic law on the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

An implementation team made up of representatives of each Participant intends to meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the Participants. In addition, the Participants intend to meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance.
Nothing in this Arrangement commits the Participants to the expenditure of any funds.
This Arrangement may commence upon signature by both Participants. This Arrangement may continue for two (2) years from the date of signing. A Participant should endeavor to provide thirty (30) days advanced written notice of its intent to discontinue the Arrangement. This Arrangement may be modified in writing at any time by mutual consent of the Participants.

The U.S. Department of Labor's Occupational Safety and Health Administration's (OSHA) Charleston Area Office and the West Virginia University Safety and Health Extension WVUS&HE)(collectively the "Participants), continue to recognize the value of maintaining a collaborative relationship to foster safety and health practices and programs to improve American workplaces. To that end, OSHA and the WVUS&HE National Resource Center hereby renew the Alliance signed March 10, 2021, and renewed March 10, 2023, with a continued emphasis on providing participants of WVUS&HE's OSHA Training Institute Education Center (OTIEC) education programs and others with information, guidance, and access to training resources that will help them protect the health and safety of workers, particularly by reducing and preventing exposure to prevalent health and safety hazards in the general industry and construction and enhancing their understanding of workers' rights and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).
This agreement provides a framework and objectives for the Alliance's activities. Alliance participants also agree to meet the requirements for program participation laid out in the "Fundamental Requirements for OSHA Alliance Program Participants" and the "Guidelines for OSHA's Alliance Program Participants: Alliance Products and Other Alliance Projects."
Through the Alliance, the organizations will use injury, illness, and hazard exposure data, when appropriate, to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options, including but not limited to member surveys, to evaluate the Alliance and measure the impact on improving workplace safety and health. In renewing this Alliance, OSHA and WVUS&HE recognize that OSHA's State Plan and On-Site Consultation Program partners are an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be shared with these partners for the advancement of common goals.
The Participants intend to work together to achieve the following objectives:
Share information on OSHA' s National Initiatives (Emphasis Programs, Regulatory Agenda, Outreach), and opportunities to participate in initiatives (such as OSHA stand downs, Focus Four Campaigns) and the rulemaking process by speaking at WVUS&HE training courses, or other events.
Share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers by conducting speeches and presentations at WVUS&HE training courses and events.
Develop and disseminate brochures/literature on common general industry and construction hazards/violations identified specifically in West Virginia and publicize the results.
Educate stakeholders and encourage the voluntary use of the free, confidential onsite consultation services provided by the West Virginia OSHA Consultation Program.
The Participants intend to work together to achieve the following objectives:
Support WVUS&HE's training and education programs for employers, employees, and safety professionals regarding hazards in general industry and construction, and communicate such information to constituent employers and workers.
Support WVUS&HE's delivery of OSHA training courses by supplementing their training with information on workers' rights, including the use of the OSHA complaint process and the responsibilities of employers, and communicate such information to workers and employers.
OSHA's Alliances provide organizations an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA's initiatives, outreach, communication, training, and education. Alliances have proven to be valuable tools for both OSHA and Alliance Participants. By entering into an Alliance with an organization, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that organization's products or services.
An implementation team made up of representatives of each organization will meet one to two times per year to track and share information on activities and results in achieving the goals of the Alliance. OSHA team members will include representatives of the Charleston Area Office and any other appropriate offices. OSHA will encourage West Virginia State Consultation Program, West Virginia Department of Labor participation on the team.

To assist in the development of effective training to promote understanding of the responsibilities of employers.

In particular, the Alliance will focus on: reducing and preventing exposure to emerging general industry hazards; addressing safety programs including hazard recognition and control and injury and illness prevention; making safety training more effective; and, understanding the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

Develop pathways to communicate information regarding the recognition and prevention of workplace hazards to employers and workers in the industry.
Encourage worker participation in workplace safety and health by training employers on how to involve employees in Job Hazard Analysis (JHAs) and hazard identification initiatives in the workplace to include the effectiveness of employee-based workplace safety committees.
The Participants intend to work together to achieve the following training and education objectives, as the opportunities or resources permit:
Develop effective training and education programs for NEPIRC stakeholders and others regarding general industry hazards, emergency preparedness, and work and life wellness programs, and communicate such information to constituent employers and workers.
Deliver or arrange for the delivery of such courses as: Two-Hour Workplace Safety Seminars, Forklift Safety, Hazard Identification/Job Hazard Analysis, Conducting Safety Audits, Personal Protective Equipment, and Safety Committee Operations.
Develop and update safety audit checklist to distribute to stakeholders to assist them on internal safety audits.
Deliver effective training and education programs for NEPIRC stakeholders and others to promote understanding of workers’ rights, including the use of the OSHA complaint process and the responsibilities of employers, and to communicate such information to workers and employers.
OSHA’s Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA’s initiatives, outreach, communications, training, and education.
