North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall from height to a hard surface: a)McGill facility - an employee who accessed the top of a semi-tanker trailer to take air monitoring samples who was exposed to a ten foot fall to a hard surface was not provided fall protection.
