29 CFR 1910.95(k)(1):The employer did not train each employee who is exposed to noise at or above an 8-hour time-weighted average of 85 decibels in accordance with the requirements of 29 CFR 1910.95(k). The employer did not institute a training program and ensure employee participation in the program: a) Production Area: An employee operating the welding machine was exposed to 68.72% of the permissible daily exposure of 85 dBA (8-hour time weighted average) or an equivalent sound level of 87.3 dBA during the 441 minute sampling period on November 30, 2021. The exposure calculation included a zero increment for the 39 minutes not sampled. The employer has not provided the employee with training on the hazards associated with high levels of noise. b) Production Area: An employee operating the welding machine was exposed to 79.71% of the permissible daily exposure of 85 dBA (8-hour time weighted average) or an equivalent sound level of 88.3 dBA during the 433 minute sampling period on November 30, 2021. The exposure calculation included a zero increment for the 47 minutes not sampled. The employer has not provided the employee with training on the hazards associated with high levels of noise.
