29 CFR 1910.38(b): An emergency action plan was not in writing, kept in the workplace, and available to employees for review. However, an employer with 10 or fewer employees may communicate the plan orally to employees. On or about February 3, 2020, the employer failed to ensure that there was a written or verbal emergency action plan in place for the safe evacuation of employees in the event one is needed.
