29 CFR 1926.1153(i)(1): The employer did not include respirable crystalline silica in the program established to comply with the hazard communication standard (HCS) (29 CFR 1910.1200), and did not ensure that each employee has access to labels on containers of crystalline silica and safety data sheets, and is trained in accordance with the provisions of HCS and paragraph (i)(2) of this section to ensure that hazards associated with cancer, lung effects, immune system effects, and kidney effects are addressed: A) Morris Painting, Inc., 1701 Mohawk School Road, Edinburg, PA - On or about 8/30/21, and at times prior thereto: Employees worked with and/or were potentially exposed to crystalline silica while conducting operations including, but not limited to, cleaning dried Anodic S/P Gray paint off of equipment. Silica was not included in the employer's hazard communication program. B) Morris Painting, Inc., 1701 Mohawk School Road, Edinburg, PA. - On or about 8/30/21, and at times prior thereto: Employees worked with and/or were potentially exposed to crystalline silica while conducting operations including, but not limited to, cleaning dried Anodic S/P Gray paint off equipment. Employees were not trained in accordance with the provisions of the Hazard Communication Standard (HCS) and paragraph (i)(2) of this section to ensure that hazards associated with cancer, lung effects, immune system effects, and kidney effects were addressed. Abatement certification is required within 10 days after the abatement date noted on the citation. This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
