29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, or flying chips and sparks: (a) On or about February 5, 2015, and at certain times before, employees working in the production areas of the plant were exposed to serious hazards, including amputations, while working with and around industrial meat processing machines that had been modified to accept vats in lieu of hoppers to catch processed meat being expelled from the machines. These modifications removed the physical barricades afforded by the hoppers and exposed employees to severe pinch point hazards caused by rotating paddles crossing the discharge door openings of the machines when vats were used in lieu of the hoppers. Abatement certification is required for this Item. Use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
