29 CFR 1910.1052(g)(2)(i): The employer did not implement a respiratory protection program in accordance with 29 CFR 1910.134 (b) through (m) (except (d)(1)(iii)), which covers each employee required by 29 CFR 1910.1052 to use a respirator: a) CTH Ventures LLC., 33 S Mann Ave., Yeagertown, PA 17099 - On or about July 12, 2023, employees were required to wear the Axis Air Group, Inc. Full Face Respirator (FF01) with the HobbyAir 1 fresh air supply system (HB01) for protection from respiratory hazards created during paint stripping. The employer did not implement a respiratory protection program in accordance with 29 CFR 1910.134(b) through (m) in that the respirator was not a NIOSH-certified respirator, employees were not fit tested with the required respirator, and employees were not provided respiratory protection training. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
