29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l): Summer Hill Multi-Family Apartments located at 565 Hank Aaron Drive, Atlanta, GA 30315, First level parking deck: On or about 09/02/2020, and at times prior, the employer exposed employees to struck-by hazards, in that the operator of the Merlo P27.6PLUS Telehandler was not familiar with the equipment, had not received training, and has no certification to operate this equipment. Uncertified operator was working in close proximity to others working on the parking deck level and using attachments not approved to be used by the manufacturer with this telehandler.
