29 CFR 1910.95(k)(1): The employer did not train each employee who is exposed to noise at or above an 8-hour time-weighted average of 85 decibels in accordance with the requirements of 29 CFR 1910.95(k): (a) The employer did not institute a training program on noise to cover the elements required under 29 CFR 1910.95(k). An employee (Track Maintenance) was exposed to continuous noise at 94.8 % of the permissible daily noise exposure (8-hour Time Weighted Average sound level of 90 dBA) during the 456 minute sampling period on July 16, 2014. For a full eight hour work shift this exposure would be equivalent to an average sound level of 90.6 dBA. Exposure calculations included a zero increment for the 24 minutes not sampled. (b) The employer did not institute a training program on noise to cover the elements required under 29 CFR 1910.95(k). An employee (Track Maintenance) was exposed to continuous noise at 108.7 % of the permissible daily noise exposure (8-hour Time Weighted Average sound level of 90 dBA) during the 271 minute sampling period on July 16, 2014. For a full eight hour work shift this exposure would be equivalent to an average sound level of 89.6 dBA. Exposure calculations included a zero increment for the 209 minutes not sampled.
