29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: The employer does not ensure that ladders used for access to an upper landing surface have side rails that extend at least 3 feet above the upper landing surface. This violation occurred on or about September 26, 2013, at pump station #1 of the Eastside Water Treatment Plant located at 405 Long Creek Road in Sunnyvale, Texas, where three employees working in a dewatering pit used a straight ladder that had side rails that did not extend at least 3 feet above the upper landing surface.
