29 CFR 1910.1052(f)(1): The employer did not institute and maintain the effectiveness of engineering controls and work practices to reduce employee exposure to or below the permissible exposure limits: a) CTH Ventures LLC., 33 S Mann Ave., Yeagertown, PA 17099 - On or about July 12, 2023, an employee using T21 Industrial Paint Remover while stripping paint from a bathtub was overexposed to methylene chloride and the employer did not ensure that employees use ventilation equipment or other work practices to reduce exposure to the lowest level achievable. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
