29 CFR 1926.451(a)(6): Scaffolds shall be designed by a qualified person and shall be constructed and loaded in accordance with that design. Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section. a. 136 Summit Avenue Jersey City, NJ Employees performing masonry work from a job-made elevated work platform constructed over an elevator shaft were exposed to a fall hazard of approximately 97ft when the platform was not designed by a qualified person. On 3/10/2021, the elevated work platform partially collapsed while two employees were working from it. One employee fell approximately 97ft to the bottom of the elevator shaft, sustaining fatal injuries. Violation occurred on or about 03/10/2021
