29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment. On or about December 14, 2018, an employee was exposed to fire hazards that resulted in second degree burns to the back and other body parts. The employee was performing a washing process that required transferring toluene from an unbonded and ungrounded 55 gallon drum via a hand pump. The employer did not ensure that an adequate assessment was conducted to determine if hazards were present which required the use of personal protective equipment against burns to the hand, back and other parts of the body. There is no abatement certification or documentation required for this item.
