29 CFR 1926.600(a)(6)(iv): A person was not designated to observe clearance of the equipment and give timely warning for all operations where it is difficult for the operator to maintain the desired clearance by visual means. At the construction site, the employer did not have a person designated to observe clearance of overhead power lines and did not have any other means to give timely warnings for operations where it was difficult for the operators of a John Deere 650DLC excavator and a Caterpillar 326FL excavator to maintain the desired clearances exposing employees to electrocution hazards.
