29 CFR 1910.178(l)(4)(ii)(B): Refresher training in relevant topics was not provided to the operator when the operator had been involved in an accident or near-miss incident: (a) On or about June 17, 2020 - 2701 Southeastern Circle, Birmingham, AL, employees were exposed to struck-by hazards when forklift drivers who had been involved in an accident or near-miss incident such as, but not limited to, forking a gasoline drum, hitting freight/denting the side of the forklift, and driving in a way that resulted in a near miss when coming out of trucks did not receive refresher training.
