Text For Citation: 01 Item/Group: 002B Hazard:
29 CFR 1910.120(q)(2): Elements of an emergency response plan. The employer shall develop an emergency response plan for emergencies which shall address, as a minimum, the following areas to the extent that they are not addressed in any specific program required in this paragraph: 29 CFR 1910.120(q)(2)(ii): Personnel roles, lines of authority, training, and communication. On or about October 9, 2020, the employer's emergency response plan did not completely address the personnel roles, lines of authority, training and communication in that the Lane Aviation Spill Prevention Control and Countermeasures Plan: a. failed to address personnel roles and clear lines of authority to include those of outside responders; b. did not clearly define the means and methods of communication for use during an emergency; and c. did not address the provisions for employee training related to specific personnel roles involved in the response plan. Employees performed required duties that involved transfer and transport of flammable liquids related to Fuel Tank Farm operations, aircraft fueling operations and associated vehicle operations with these required duties on a daily basis.
