Text For Citation: 01 Item/Group: 002 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of high heat while performing job duties. a) On or about and at times prior to May 27, 2024, employees were exposed to the hazard of high heat from direct sunlight during the performance of their job duties, including moving plants during shipping operations for 8 hours. The calculated Wet Bulb Globe Temperature (WBGT) ranged from 24? to 32? (75? to 90?) with a heat index up to 105 degrees Fahrenheit while working in direct sunlight performing moderate manual labor and wearing baseball or sun hats, long sleeves and long pants. Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke.
