29 CFR 1910.147(c)(4)(ii): The energy control procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29CFR 1910.147(c)(4)(ii)[A], 29CFR 1910.147(c)(4)(ii)[B], 29CFR 1910.147(c)(4)(ii)[C], and 29CFR 1910.147(c)(4)(ii)[D]: On or about November 30, 2020, at the Midwest Scrap Management yard located at 850 East 45th Street North Park City, Kansas, the employer is failing to protect employees from struck-by and crushing hazards. The employer failed to adequately develop written lockout/tagout procedures for employees to follow while servicing and maintaining equipment including but not limited to the Harris HS 98115 auto shredder machine, the balers, the crane-cable, the material handler crane, the forklift, the skid steer loaders, the hydraulic shears, and the truck. The equipment specific lockout/tagout procedures did not include: (A) A specific statement of the intended use of the procedure (B) A listing of all energy sources including but not limited to pneumatic, electrical, and gravity (C) The specific location of all listed energy sources (D) The specific devices to be used to de-energize each energy source including but not limited to locks and hasps and ball valve lockout devices etc. (E) The specific procedures for the temporary removal or transfer of lockout/tagout devices for the purpose of testing or positioning, or clearing jams (F) The specific steps to test and verify the effectiveness of the energy control devices and energy control measures prior to beginning or re-engaging in work. 29 CFR 1903.19(d)(1) requires certification and documentation that the abatement of the above violation is complete.
