29 CFR 1910.178(m)(2): No person shall be allowed to stand or pass under the elevated portion of any truck, whether loaded or empty. At the establishment located at 1400 Plover Road, Plover, Wisconsin; the employer failed to ensure that employees do not pass beneath elevated forklifts on the loading dock, exposing them to struck-by hazards. On or around August 23, 2024, an incident occurred on dock R22 involving an employee operating a Yale sit-down forklift (Model: GLC060VXNDSQ084, Serial: C910V02484N). During this time, another employee working on the ground between the rail car and loading dock passed under the forklift, which was removing a Torbeck Dockboard (model: 9298/72, serial: 10966), leading to the dock board slipping off and striking the employee, resulting in a fatality.
