29 CFR 1910.1052(e)(1): The employer did not establish a regulated area wherever an employee's exposure to airborne concentrations of MC exceeds or can reasonably be expected to exceed either the 8-hour TWA PEL or the STEL. a. Bath Magic, Inc. jobsite located at 1255 South Byrne Rd., Toledo, Ohio: On or about September 13, 2011, the employer did not ensure a regulated area was established prior to a subcontractor using a methylene chloride stripper to remove a coating from a bathtub. Regulated areas require the following: 1. Access was not limited to regulated areas only to authorized employees; 2. Proper respirators were not supplied and used by each employee working inside of a regulated area; 3. The regulated area was not marked to distinguish the boundary of the regulated area; 4. Employees cannot engage in any activity that would compromise the effectiveness of the respiratory protection being worn.
