OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crush-by hazards: (a) On or about 3/3/2023: 5835 Route 5, Herkimer, NY 13350: Employer failed to ensure that employees used equipment such as a 22-Ton NAPA 791-5280 Jack Stand to lift vehicles safely and according to the manufacturer's instructions, which exposed employees to crush-by-hazards by from vehicles falling off the jack stand. (b) On or about 3/2/2023: 5835 Route 5, Herkimer, NY 13350: Employer failed to ensure that employees used equipment such as a 22-Ton NAPA 791-5280 Jack Stand to lift vehicles safely and according to the manufacturer's instructions, which exposed employees to crush-by-hazards by from vehicles falling off the jack stand.
