Text For Citation: 01 Item/Group: 001A Hazard:
OSH ACT of 1970 Section (5)(a)(1) Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that on August 30, 2021 an employee was exposed to an electrical shock while coming into close proximity to a ground wire on a transmission structure. a.) Morris Painting, Inc. - 1701 - Mowhawk School Road Edinburg, PA: On or about 8/30/2021, employee was conducting painting operations at an elevated section of the power transmission tower near the ground wire. Abatement Note: Among other methods, feasible and acceptable means to abate this hazard would be the following: Employer will establish a work practice requiring that employees not paint within two (2) feet of any ground wire on electrical transmission structures unless it is determined to be safe by the utility company or host employer. In addition, the employer agrees to incorporate into its employee training the potential hazards associated with static electricity/induced voltage and ground wires. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation. This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.
