OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to drowning hazards when operating small vessels without wearing a personal flotation device (PFD): Wilson Cove, San Clemente Island: On or about 3OCT13, October 3, 2013, the employer failed to ensure that employees operating motor boats on open water were wearing personal floatation devices. An employee, who was not wearing a personal floatation device, was operating a motor boat on a maintenance test ride when he fell from the boat and drowned.
