OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees On or about March 23, 2013 the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. Employees were exposed to struck-by and crushing hazards from moving vehicular traffic. A feasible means of abatement would be to install a protective barrier protecting all sides of the safety area to protect workers from being struck by moving motor vehicles and allows for safe entry and egress.
