OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck-by cut-off machinery and/or other objects: a) Employees were exposed to the hazard of contacting a rotating cutting blade, being struck-by thrown objects, and/or reactive forces, including kickback, where a carbide-tipped wood-cutting circular saw blade was provided and used with a Stihl TS 420 cut-off machine. b) Employees were exposed to the hazard of contacting a rotating cutting blade, being struck-by thrown objects, and/or reactive forces, including kickback, where a Stihl TS 420 cut-off machine was provided and used to cut wood products. Among other methods, feasible and acceptable means of abatement would include ensuring the use of only Stihl-branded diamond and composite abrasive wheels as prescribed in the instruction manual for Stihl TS 420 cut-off machines. Additionally, as prescribed by the manufacturer, ensure the Stihl TS420 cut-off machine is never used to cut wood products. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
