Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment that was free from recognized hazards that were causing or are likely to cause death or serious physical harm to his employees, in that employees were exposed to serious crushing type injuries while operating powered industrial trucks without being required at all times to wear the protective operator restraint systems provided on the powered industrial trucks: (a)An employee operating a powered industrial truck in the warehouse and loading dock area was exposed to an increased risk of injury in the event of a lift truck accident due to the employer's failure to uniformly and consistently enforce the requirement that lift truck operators wear their seat belts at all times while operating the lift trucks. Recognition of the hazard of powered industrial truck rollover-type accidents and the need for the use of an operator restraint system is evidenced by certain requirements in the ASME/ANSI B56.1-2000 consensus standard for powered industrial trucks; the ASME/ANSI B56.1a-2001 Addenda to ASME/ANSI B56.1-2000; the lift truck operating manual; signage on the lift truck itself. On August 24, 2010, an employee operating a powered industrial truck was fatally injured when the lift truck was accidentally driven over the edge of an elevated loading dock. The employee attempted to jump clear as the lift truck fell but was struck and pinned to the concrete surface by the protective cage of the lift truck. At the time of the accident the operator was not wearing the seat belt provided on the unit. Abatement Certification is required for this item - Use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose. (1)One feasible and acceptable method to correct this hazard is to establish and enforce a program of observation and supervision to ensure that all employees operating powered industrial trucks consistently and uniformly secure themselves in their operating positions by the use of the operator restraint systems provided on the units; and (2)Additionally, develop instructional language and requirements for seat belt usage into the company Forklift Training Program.
