Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by and/or caught between the larrycar and fixed structures: a)top side of coke oven, just north of "the gap", near the fresh air room. On or about August 7, 2010, and at times prior thereto: employees were working in and around the larrycar and fixed structures such as, but not limited to, the fresh air room and were not protected from being struck by the larrycar or caught in between the larrycar and the fixed structures. Abatement Note: Among other methods, feasible and acceptable abatement methods to correct this hazard would be, but not limited to: 1)Install additional working lights and/or sounds to indicate to employees the direction of travel of the larry car. These lights and/or sounds should be distinctly different so employees can distinguish the direction of travel and be alerted; or 2)Establish a written safe operating procedure to prevent employees from being in the hazardous area during larrycar movement; or 3)Install barriers or rail arms that can be dropped into place by the larryman to signify "no entry" to other employees working on the coke oven.
