Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or serious physical harm to his employees in that employees were exposed to struck by/crushing hazards: (a) Miles City Livestock Commission: On or about March 23, 2010 and at times prior thereto, employees were exposed to a struck by and crushing hazard while working with livestock. (b) Miles City Livestock Commission: The employer did not provide a training program for each employee who might be exposed to struck by and crushing hazards while working with livestock. The program shall enable each employee to recognize the hazards of working with livestock and shall train each employee in the procedures to be followed in order to minimize these hazards. Among other methods, recognized and feasible means of abatement to correct this hazard is to: (1)Provide safety training to ensure everyone understands cattle behavior. (2)Place sturdy barriers between cattle and persons. (3)Develop policy and procedures to direct employees to practice extreme caution when handling dangerous animals and ensure that employees leave themselves an "out" when working in close quarters.
