Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:04/07/07 Location:Track #3 Siding, Southwest of Rotary Dumper House Equipment:Locomotive, Diesel Electric Power; Coal Hopper Cars Number CSX 385208, Locomotive Remote Control Condition:The employees of the Fuel and Ash Team moved, de-coupled, unloaded, and coupled rail coal cars, using procedures which did not adequately protect the Cut-Off Man from being caught and crushed between two rail cars. Among other methods, one feasible and acceptable means of abatement would be to comply with the rules, procedures, and policies concerning the function of coupling and de-coupling rail cars on plant property which have been established and used by the rail industry. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.
