Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:05/09/03 Location:Mixing Area Condition:Employees were exposed to the hazard of fire and explosion from the ignition of flammable vapors by static electricity when MPP-611(a micronized polymer powder) was added to a mixing tank containing xylene and toluene by dumping the material from a 121 pound drum and allowing it to free fall approximately 4' to the solvent level. Among other methods, one feasible and acceptable abatement method to correct this hazard is to add the micronized polymer in a slurry with a conductive solvent, or to add the micronized polymer in small quantities using a chute that is bonded and grounded in accordance with NFPA 77 and extends to the level of the solvent, or to inert the atmosphere within the mixing tank prior to adding the micronized polymer. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.
