Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Site - Cast House - Screening Station - On or about 4/5/99 the dumping of aluminum powder allowed dust levels to build up to the extent that an explosive atmosphere occurred with a flash fire resulting. A shovel constructed of nonsparking material was not in use. Reference: National Fire Protection Association, NFPA 65, Standard for the Processing and Finnishing of Aluminum. One acceptable method of abatement, but would not be limited to, would be to provide mechanical ventilation when processing aluminum powder as per NFPA 65, and to use non- sparking tools.ng
