Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushed-by hazards: On or about December 10, 2024, and times prior there to, employees operated a Donkey forklift and a Caterpillar forklift in areas exposing them to crushed-by hazards from a forklift tip-over as follows: a) Employee(s) operated a Donkey Forklift Model M13-5k, the loading yard area, without wearing the manufacturer installed seat belt to move, load, and unload product and material; and b) Employee(s) operated a Caterpillar Forklift Model DP40k, in the loading yard area, that the employer had failed to retrofit a seatbelt for operators to use when moving, loading and unloading product and material.
