29 CFR 1910.269(m)(3)(vi): After the applicable requirements in paragraphs (m)(3)(i) through (m)(3)(v) of this section have been followed and the system operator gives a clearance to the employee in charge, the employer did not ensure that the lines and equipment are deenergized by testing the lines and equipment to be worked with a device designed to detect voltage: (a)Hooper Corporation at transmission line structure No. 31, Southwest Pole, Empire, CO 80438: On or about July 29, 2024, the employer did not ensure that the electrical transmission line that was energized at 115kV was de-energized prior to two employees being flown into position from a helicopter long-line to replace a static dampener on the ground line above it. During the process of replacing the dampener the two employees sustained serious electric shock and burn injuries. One of the employees died from his injuries.
