29 CFR 1926.1441(c)(2)(i): The employer did not develop and ensure compliance with all procedures necessary for the safe operation of the equipment and attachments when the manufacturer's procedures are unavailable. Location: a) Worksite; Building # 1 a) On or about 7/10/2024, an employee was working on the ground level and was entangled in the debris tarp when it was hoisted up and he fell 18 stories as the tarp reached the 18th floor. The employer did not develop, and ensure compliance with, procedures necessary for the safe operation of the hoist equipment and debris tarp. The employer had planned to use hand held radios, and allowed the workers to deviate from the plan by using cell phones.
