29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met (29 CFR 1926.59: An employer engaged in construction activities did not comply with the requirements set forth in Part 1910, Section 1200, Hazard Communication). On or about September 6, 2023, the employer did not develop and implement a written hazard communication program for employees working with hazardous chemicals to heat up and install thermal roof barriers, exposing employees to hazards such as, but not limited to inhalation and dermal contact.
