Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. The employer failed to protect employees from hazards while performing lawn mowing activities. This was most recently identified on September 12, 2022, at the establishment located at 9066 State Highway W, Butterfield, Missouri. An employee was operating a John Deere brand, zero-turn radius, riding lawnmower, model Z915B, serial number 031745, on a slope greater than manufacturer's recommendation. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS TO: (1) Follow John Deere's operating instructions to determine slope angles of the area to be mowed. (2) Follow John Deere's operating instructions by not operating the machine on slopes greater than 20 degrees. (3) Discontinue mowing the areas owned by MODOT. (4) Require employees to wear the seatbelt installed on the equipment.
