OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by a Caterpillar 972K Wheel Loader. a) Worksite, 38-96 Long Beach Road, Island Park NY - ready mix loading yard: On or about September 11, 2021, an employee was permitted to enter an area in which a CAT 972K (S/N: CAT0972KEZ4W00661) Wheel Loader was in operation and loaded with a waste concrete slab. The employee was not protected from being struck by the front end loader. Note: In addition to abatement certification, the employer is required to provide abatement documentation for this item in accordance with 29 CFR 1903.19.
