29 CFR 1910.23(b)(9): The employer did not ensure that ladders are inspected before initial use in each work shift, and more frequently as necessary, to identify any visible defects that could cause employee injury. The employer is failing to ensure that employees are protected from fall hazards resulting from the failure to ensure ladder inspections are accomplished prior to use in two instances: 1.) When using the permanent ladder accessing the roof to assess the kitchen exhaust units 2.) When a-frame ladders are utilized during daily equipment maintenance This was most recently documented at Dave and Buster's located at 2502 S. 133rd Plaza, NE 68144 on August 7, 2021. The employer and one employee used the ladder to access the roof approximately nine feet above the lower surface.
