OSH ACT of 1970 Section (5)(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of being struck by heavy construction equipment. a) On or about February 18, 2021, located in the front of a residence where employees were exposed to struck-by hazards when moving a SDP 5500, Serial No. 101958881421, EZ Hauler Machine on a sloped terrain at an angle without extending the tracks.
